A deambulação do conceito, de noções filosóficas a noções técnicas, e destas para noções éticas, é o pano de fundo deste estudo, cujo centro está na caracterização dos seus novos contornos. A noção de interesse público é central em todo o direito administrativo, pois se constitui em ferramenta de legitimação e de controle das manifestações de poder do Estado. No entanto, apesar de o tema percorrer, necessariamente, toda a teoria administrativista, não tem sido significativo o esforço da doutrina em desvendar o verdadeiro conteúdo do interesse publico, valendo-se, muitas vezes, da justificativa de sua inclusão na categoria dos conceitos jurídicos indeterminados. É possível perceber as razões da mudança, contudo, a partir do estudo das transformações dos modelos de Estado reconhecidos pela doutrina (Liberal, Social e Subsidiário). Definições formais, técnicas e quantitativas, que apontam o interesse público nos interesses gerais da coletividade titularizados pelo Estado, mostraram-se insuficientes para identificar o interesse publico nos fatos e nos conflitos da contemporaneidade, dinâmicos e plurais. A deficiência da lei em definir com precisão o interesse público no caso concreto, a carência de legitimidade nas decisões do Poder executivo, a dificuldade do Estado em atender às necessidades sociais e o fortalecimento da sociedade civil foram situações determinantes para a alteração da visão do conceito de interesse público. Despojada de critérios exclusivamente quantitativos e das limitações trazidas pelo ideário do serviço publico, a visão contemporânea de interesse publico emergiu de forma mais ética e mais comprometida com a vontade da sociedade civil. Presenciou-se a busca por valores morais versados à dignidade da pessoa humana, bem como a participação de setores não-estatais na escolha e na realização do interesse publico. O interesse público que instrumentaliza o direito administrativo assume, assim, novos contornos, os quais permitem visualizar o publico fora do Estado e a incrementação do controle, da Administração e do setor não-estatal, exercido pela sociedade.Abstract: It has been contemporaneously noticed that the public interest, which guides us now is not the same as in the past, once its essence has changed. The migration of the concept, from philosophical to technical notions and from there to ethical notions, is the tapestry of this study; whose center is the characterization of its new outlines. The notion of public interest is central to all administrative law, once it constitutes a legitimization tool and for controlling the State's displays of power. Nevertheless; besides the theme having to necessarily run the entire administrative theory the doctrine's efforts have not been significant in unmasking the true content of the public's interest, and for many times that ends on the justification for its inclusion in the undetermined legal concepts category. It is possible to notice the reasons for change, nevertheless, from the study of the transformation of the States models, which are acknowledged by the (Liberal, Social and Subsidiary) doctrines. Formal, technical and quantitative definitions, which pointed to the public interest within the general interests of the community group entitled by the State, have shown to be insufficient in identifying the public interest and with the dynamic and plural contemporaneous conflicts. The law's deficiency to precisely define the public interest in the concrete case, the lack of legitimacy in the decisions of the Executive Power, the difficulty of the State to attend the social needs and the strengthening of the civil society were the determining conditions for altering the public's interest view of the concept. Deprived of exclusive quantitative criteria and of the limitations brought about by the ideas of the public service, a contemporaneous version of the public interest emerged in a more ethical and committed manner by the will of the civil society. It witnessed the search for moral values versed in the dignity of the human being, as well as the participation from the non-governmental sectors in choice and in the realization of the public interest.
