Defesa : Curitiba, 01/04/2019Inclui referências: p. 191-210Resumo: Partindo de uma epistemologia feminista e buscando fundamento em perspectivas não essencializadoras, baseadas nas experiências das diversas mulheres, o presente trabalho pretende investigar quais são os discursos jurídicos que tratam da questão da violência sexual, bem como as suas relações e implicações com uma profunda estrutura de gênero que sustenta um mecanismo de expropriação do feminino. Compreendendo, assim, o direito enquanto uma tecnologia de gênero e olhando com desconfiança as promessas do sistema criminal, propõe-se a indagação sobre quais ramos do direito abordam o fenômeno da violência sexual, e sob quais justificativas o fazem. A constatação de que o tema é trabalhado, no âmbito jurídico, quase que exclusivamente a partir do sistema penal leva à necessidade de estudar os discursos que moldam o tratamento da violência sexual, enquanto crime, nas esferas legais, parlamentares, doutrinárias e judiciais, buscando abranger os três componentes do fenômeno jurídico expostos na metodologia proposta pela jurista feminista Alda Facio: componente formal-normativo, componente estrutural e componente cultural. Para tanto, analisa-se a redação original do Código Penal de 1940 referente a alguns dos delitos sexuais, bem como os discursos que sustentaram as reformas nos anos de 2005 (Lei 11.106), 2009 (Lei 12.015) e 2018 (Lei 13.718). São analisados, ainda, os roteiros e os mitos que orientam a compreensão social e jurídica do estupro, e os impactos dessas construções em julgamentos proferidos em primeiro grau de jurisdição, a partir de pesquisa empírica que analisou 25 sentenças judiciais referentes à imputação de estupro oriundas de três diferentes comarcas do Tribunal de Justiça do Paraná. Na última parte do trabalho, a proposta é identificar quais são os sentidos em torno do fenômeno da violência sexual. Assim, após a análise de três vertentes teóricas dos feminismos norteamericanos, evidencia-se a perspectiva elaborada pela antropóloga argentina Rita Laura Segato, ressaltando o aspecto expressivo e comunicacional da violência sexual, por meio do qual fala uma estrutura fundante das sociedades modernas, que é a relação patriarcal de gênero. Procurase, nesse momento, costurar teorias para buscar a compreensão dos mecanismos de (re)produção dessa estrutura, que promove uma exclusão inclusiva do feminino, de seus significantes e de seu corpo, mediante a sua incorporação em uma economia simbólica de expropriação de tributos. Pretende-se, assim, investigar sobre os significados das práticas de violação sexual contra mulheres no contexto de uma política que parece se fundar e incidir nos corpos femininos. Palavras-Chave: Violência sexual; Discursos jurídico-penais; Reformas dos crimes sexuais; Estrutura patriarcal de gênero; Biopolítica.Abstract: Starting from a feminist epistemology and searching foundation in non essentializing perspectives, based on the experiences of the different women, the present work intends to investigate which are the legal speeches that address the sexual violence issue, as well as it's relations and implications with a deep gender structure which supports a mechanism of expropriation of the feminine. Comprising, this way, the law as a gender technology and looking distrustful the promises from the criminal system, it is proposed the inquiry about which branches of law address the sexual violence phenomenon, and under which justification they do. The confirmation that the topic is worked, under the legal scope, almost exclusively from the criminal system leads to the need to study the speeches who shape the treatment of sexual violence, while crime, in the legal, parliamentary, doctrinal and juridical spheres, seeking to reach the three components of the juridical phenomenon in the methodology proposed by feminist jurist Alda Facio: formal-normative component, structural component and cultural component. Therefore, it is analyzed the original writing of the 1940's Penal Code of some of the sexual offenses, as well as the speeches that supported the reforms in the years of 2005 (law 11.106), 2009 (law 12.015) and 2018 (law 13.718). Are analyzed, yet, the scripts and myths which guide the social and juridical comprehension of the rape, and the impacts of this constructions on judgements pronounced in the first degree of jurisdiction, from empirical research that analyzed 25 verdicts about the imputation of rape from three different counties of the Court of Justice of Paraná. In the last section of the work, the proposal is to identify which are the meaning around the sexual violence phenomenon. Thus, after the analysis of three theoretical proposals of the north-american feminisms, it is evidenced the perspective formulated by the argentinian anthropologist Rita Laura Segato, highlighting the expressive and communicational aspect of the sexual violence, through which speaks a structure founder of the modern society, which is the patriarchal relations of gender. It is searched, in this moment, to sew theories to search the comprehension of the mechanisms of (re)production of this structure, which promotes an inclusive exclusion of the feminine, her signifiers and her bodies, through her incorporation in a symbolical economy of expropriation of tributes. The aim is to investigate the meanings of the practices of sexual violation against women in the context of a policy that seems to be based on and to operate on women's bodies.
