Defesa: Curitiba, 30/03/2016Inclui referências : f. 159-172Resumo:O objetivo deste trabalho é estudar a origem autoritária da Lei n. 6.815, de 1980, conhecida como Estatuto do Estrangeiro e, ao mesmo tempo, ter a pretensão de indicar outro paradigma para a constituição de uma lei das migrações que revogará o primeiro. A hipótese é a de que a Doutrina da Segurança Nacional, ideologia militarista que extrapolava os limites de competência das Forças Armadas e serviu, por isso, como meio de implementação e legitimação institucional do regime ditatorial no Brasil, foi utilizada como fundamento para a redação da referida lei dos estrangeiros em 1980. Crê-se que, ainda hoje, há continuidade desse viés autoritário na política pública migratória do país, uma vez que parte da situação jurídica do imigrante não condiz com os direitos fundamentais veiculados pela Constituição Federal de 1988. Dessa maneira, estuda-se a recepção implícita que ocorreu com o Estatuto do Estrangeiro após 1988 e, por isso mesmo, a possibilidade de ajuizamento de Arguição de Descumprimento de Preceito Fundamental em face de determinados dispositivos da lei a fim de declará-los não recepcionados. Na busca por uma nova lei das migrações, a maior abrangência de seu objeto já indica o novo fundamento pelo qual deve ser construída: o desenvolvimento humano. Defende-se que o desenvolvimento humano deve substituir a Doutrina da Segurança Nacional para que a política pública migratória, cujo vértice é o Estatuto do Estrangeiro, possa estar de acordo com a Constituição. Trata-se de uma virada paradigmática. Ao final do trabalho, estudam-se os anteprojetos e projetos de lei que pretendem revogar, parcial ou globalmente, a Lei n. 6.815/1980 e que estiveram, ou estão, em trâmite no Congresso Nacional. Identificam-se diferenças e, mais ainda, semelhanças entre eles e analisa-se se estão em conformidade com o novo paradigma proposto.Abstract: The purpose of this work is studying the authoritarian genesis of the Act n. 6.815, of 1980, known as Foreigner Act. In the same time, it has the intended of indicate another paradigm for the constitution of a migrations' law which will revoke the Foreigner Act. The hypothesis is that National Security Doctrine, a militarist ideology which had surpassed the Armed Forces' competence boundaries, had served as a mean of the institutional legitimation and implementation of a dictatorial regime in Brazil. Thus, this doctrine was the fundament for the foreigners' law of 1980. It is believed that, until today, there is a continuity of this authoritarian side in international migratory policies, because part of the juridical regime of immigrants in Brazil does not respect the fundamental rights written in the Federal Constitution of 1988. Therefore, it is studied the implicit reception of the Foreigner Act after 1988, and the possibility of the use of a Claim of non-compliance with a fundamental precept (ADPF, in Portuguese) against some articles of the act. In the search of new migrations' law, a wider purpose indicates a new foundation which it has to be constructed: the human development. It is defended that the human development has to substitute the National Security Doctrine to fit the international migratory policies, whom the Foreigner Act is its apex, with the Constitution. This idea is a paradigmatic turning point. In the end of this study, it is analyzed the drafts and projects of law with the objective of revoke, partial or globally, the Foreigner Act. The majority of these drafts are in the National Congress for discussion.
