Defesa : Curitiba, 07/05/2020Inclui referências: p. 229-258Resumo: A dissertação que ora se apresenta tem como principal objetivo analisar a possibilidade de se reconhecer um direito humano à identidade de gênero na Convenção Americana de Direitos Humanos, de modo a se erigir uma proteção à pessoa trans. Buscou-se demonstrar que as pessoas trans foram construídas como figuras abjetas e desprovidas de reconhecimento enquanto sujeitos, como patologias médicas passíveis de serem tratadas e curadas. Estando expostas às mais diversas formas de violência e abuso, acabam por sobreviver em uma situação de completo abandono, às margens da sociedade e da própria humanidade. Exemplo dessa vida precária são as informações e dados referente às pessoas trans no Brasil, que acabam por demonstrar altos índices de violência e de vulnerabilidade social e econômica. Nesse contexto, faz-se necessária a busca de instrumentos de proteção, os quais podem ser encontrados no direito internacional dos direitos humanos. Por meio de uma interpretação evolutiva da Convenção Americana de Direitos Humanos e dos direitos lá assegurados, buscou-se construir as bases teóricas para o reconhecimento da identidade de gênero enquanto direito humano, com a consequente proteção da pessoa trans, de modo a promover a cidadania, a inclusão, a igualdade e demais direitos essenciais ao pleno exercício e gozo da dignidade humana inerente a todos e todas. Transgênero; LGBTI;Abstract: The main objective of this dissertation is to analyze the possibility of recognizing the human right to gender identity in the American Convention on Human Rights, in order to establish a protection for trans people. It was sought to demonstrate that trans people were built as abject figures, without recognition as a person, as mere medical pathologies that could be treated and cured. Being exposed to the most diverse forms of violence and abuse, they end up surviving in a situation of complete abandonment, on the margins of society and humanity itself. An example of this precarious life is the information and data on transgender people in Brazil, which shows up high levels of violence and socio-economic vulnerability. In this context, it is necessary to search for instruments that can be used as a protection tool, which can be found in the International Human Rights Law. Through an evolutionary interpretation of the American Convention on Human Rights and the rights guaranteed there, we sought to build the theoretical bases for the recognition of gender identity as a human right, with the consequent protection of the trans person, in order to promote citizenship, inclusion, equality and other rights that are essential to the full exercise and enjoyment of the human dignity inherent to all.
