Defesa : Curitiba, 17/04/2023Inclui referências: p. 164-180Resumo: Este estudo propõe-se a extinção do debate, entre os pais, da guarda da prole, porque equivale a uma categoria jurídica eivada das deficiências de sobreposição, de inutilidade e de periculosidade. O desenvolvimento do raciocínio defendido parte de uma investigação, com o apoio instrumental da história e da antropologia, sobre a maternagem ser um determinismo biológico entalhado na natureza feminina ou se, ao contrário, os comportamentos das mães acerca dos cuidados das crianças assumem aspectos contingenciais. Uma inspeção em amostras de atitudes maternais - em épocas, classes sociais e culturas diferentes - serve para provar a (in)existência universal incondicionada da maternagem em todas as mulheres e em relação a todos os filhos. Em seguida, são analisadas, empiricamente, decisões judiciais, no intuito de evidenciar se há uma predileção do Poder Judiciário pela fixação da guarda em favor da mãe e, nas hipóteses de guarda compartilhada, uma preferência pela fixação de residência materna. A pesquisa científica permite confirmar se as decisões judiciais incentivam o compartilhamento de responsabilidade e cuidado entre os genitores ou se, em vez disso, o Poder Judiciário reflete e reforça, na prática, a noção de maternagem inata, destinada às mulheres. Comprovada que é uma construção social corroborada pelo Estado, não há fundamento para se insistir numa disputa sobre quem deve cuidar diariamente dos filhos; afinal, se os pais também puderem ser cuidadores das crianças, o instituto da guarda disputada entre os genitores perde sua função. A mais, essa exclusão proposta nesta tese permitirá que não mais haja confusão entre a guarda e o poder familiar e que seja outorgada, de modo efetivo, a responsabilidade igualitária aos pais homens. Repensar o instituto da guarda de filhos disputada entre os pais é conduta essencial em direção à igualdade de gênero, ao respeito à diversidade e ao cuidado verdadeiramente democrático.Abstract: This thesis will investigate, with the instrumental support of history and anthropology, whether mothering is a biological determinism carved into female nature or, on the contrary, whether mothers' behaviors regarding child care assume contingency aspects. An inspection of samples of maternal attitudes - in different times, social classes and cultures - serves to prove if there is a situation of unconditional universal mothering in all women and in relation to all children. Then, judicial decisions are empirically analyzed, in order to show whether there is a predilection of the Judiciary for the establishment of custody in favor of the mother and, in the cases of shared custody, a preference for the establishment of maternal residence. Empirical analysis allows us to confirm whether judicial decisions encourage the sharing of responsibility and care between parents or, instead, if the Judiciary reflects and reinforces the notion of innate mothering, destined for women. Based on this diagnosis, it is proposed to put an end to the debate, between parents, about the custody of their children, because it is equivalent to a legal category fraught with deficiencies of overlap, uselessness and danger. Having proven that mothering is a social construction supported by the Judiciary, there is no basis for insisting on a dispute over who should take care of the children on a daily basis; after all, if the parents can also be caregivers of the children, the institute of disputed custody between the parents empties its function. Furthermore, the exclusion proposed in this thesis will allow that there is no longer any confusion between custody and parental authority and that equal responsibility is effectively granted to male fathers.
