Defesa: Curitiba, 08/04/2016Inclui referências : f. 245-259Área de concentraçãoResumo: Contemplamos no presente estudo de tese de doutoramento as principais atitudes e relações políticas do rei Afonso X de Castela, com destaque para as várias dificuldades por ele encontradas no governo do reino castelhano pós movimento de conquista ibérica dos cristãos sobre os muçulmanos. Ressaltamos o desejo do rei pela coroa do Sacro Império Romano Germânico, bem como as suas difíceis relações com o poder espiritual na época, em meio ao intenso desenvolvimento das universidades na Cristandade Latina. Inicialmente, orientamos o nosso trabalho para uma investigação do universo jurídico da época, e para isso retornamos à Universidade de Bolonha, berço importante da tradição legal medieval; depois exploramos a transladação e o espraiamento dos sábios bolonheses para outros centros culturais, como a Universidade de Salamanca e a Escola de Tradutores de Toledo, na Península Ibérica. Esses centros recepcionavam, além dos mestres bolonheses, também os de origem bizantina, judaica, islâmica e latina, em geral. Destacamos, pois, que a Universidade de Salamanca e a Escola de Tradutores de Toledo foram intensamente patrocinadas por Afonso X, pois delas advinham seus sábios do scriptorium real. Considerando esse panorama de crescimento dos estudos jurídicos na Idade Média do século XIII - movimento, aliás, que se relaciona com o fortalecimento do poder temporal -, passamos então à investigação da principal fonte do presente estudo, Las Siete Partidas. Acreditamos que esse documento normativo sintetiza, por meio do direito, os pensamentos do rei Afonso X em relação aos seus projetos políticos na época. Em um primeiro momento buscamos a compreensão da estrutura e das principais características da obra, entre o viés teórico e o pragmático. Em seguida, partimos para a análise da fonte, rastreando em Las Siete Partidas o conceito de "justiça", o qual destacamos como fundamental na construção da obra. Propomos, diante das constatações, a nossa hipótese: a existência, através do conceito de justiça, de uma tradição oriental com forte matiz salomônico para o modelo de rei ibérico assumido por Afonso X. Do nosso trabalho de investigação, portanto, verificamos que em Las Siete Partidas o rei Afonso X se dedica a fortalecer as suas prerrogativas em relação à sociedade dos nobres; e o conceito de Justiça, virtude que especialmente ele deveria cultivar, caminha justamente nesse sentido: tornando-o um governante ideal e universal, centralizador e organizador de uma sociedade múltipla, e regulador dos nobres do reino - atitudes essenciais ao plano político de Afonso X em seu contexto.Abstract: We contemplate in this doctoral thesis study the main attitudes and political relations of the king Alfonso X of Castile, highlighting the various difficulties he encountered in the government of the Castilian kingdom soon after the Christians conquest of Iberian Peninsula over the Muslims. We emphasize the desire of the king for the crown of the Holy Roman Empire, as well as his difficult relations with the spiritual power at the time, amid the intense development of the universities in Latin Christianity. Initially, we guide our work for an investigation of the juridical universe at the time, and to do that we return to the University of Bologna, an important birthplace of the medieval legal tradition; then we explored the translocation and the spreading of the Bologna wise men to other cultural centers such as the University of Salamanca and the Toledo School of Translators, in the Iberian Peninsula. These centers received, in addition to the Bolognese masters, also those of Byzantine origin, Jewish, Islamic and Latin, in general. We emphasize, therefore, that the University of Salamanca and the Toledo School of Translators were heavily sponsored by Alfonso X, places where he recruited his wise men for the real scriptorium. Considering this growth panorama of the juridical studies in the Middle Ages of the thirteenth century – movement, incidentally, related to the strengthening of the temporal power –, we follow the to research of the main source of this study, Las Siete Partidas. We believe that this normative document synthesizes, by means of the law, King Alfonso X's thoughts in relation to their political projects at the time. At first we seek the understanding of the structure and the main characteristics of the work, by investigating the theoretical framework and the pragmatic. Then we start to analyze the source, tracking in Las Siete Partidas the concept of "justice," which one we highlight as fundamental in the construction of the work. We propose, on the findings, our hypothesis: the existence, through the concept of justice, of an oriental tradition with strong Solomonic hue for the Iberian king model assumed by Alfonso X.
