Defesa: Curitiba, 07/03/2016Inclui referências : f. 224-235Resumo: A proibição ao aborto é uma forma de dominação do corpo feminino e deriva de elementos religiosos, da ideia de pecado, da noção de sacralidade da vida humana, traduzida na defesa do direito ao nascimento e da proteção do nascituro enquanto argumentos jurídicos. O controle do corpo da mulher é também um produto do patriarcado, a forma de dominação da mulher pela figura masculina. O movimento feminista se ocupa, desde seu início, da luta por direitos sexuais e reprodutivos, com mais ênfase no tema a partir da década de 1960. O aborto é um crime no Brasil, previsto no Código Penal, nos art. 124 e seguintes e punido com detenção. No entanto, a tipificação não tem efetividade, uma vez que não há grandes números de condenações baseadas na prática. A criminalização leva as mulheres que recorrem ao aborto à clandestinidade, coloca em risco saúde e vida, além de haver a possibilidade de persecução penal. O objetivo da presente pesquisa é examinar os argumentos sobre o tratamento jurídico do aborto em algumas de suas facetas: a) inicialmente, versará sobre os estereótipos femininos no cristianismo, contraponto o modelo da mulher "santa" à "pecadora"; tratará dos reflexos da submissão feminina na filosofia e o início de uma nova linguagem sobre a mulher, com o rompimento com a lógica de dominação; passará para as reivindicações feministas quanto a direitos sexuais e reprodutivos até alcançar as defesas morais do aborto; b) a segunda parte objetiva tratar da realidade brasileira, partindo da laicidade do Estado e da influência religiosa na política desde a Assembleia Nacional Constituinte, passando pela presença do movimento feminista na reivindicação de liberdade e autonomia sobre o próprio corpo e alcançando as propostas legislativas relacionadas ao aborto; abordará, ainda nesse espectro, da decisão da Suprema Corte estadunidense em Roe v. Wade, caso que resultou na descriminalização do aborto no país; c) a parte final da pesquisa abordará as decisões do Supremo Tribunal Federal que trataram de temas correlatos ao aborto, bem como das audiências públicas que informaram as decisões. Os casos analisados serão a Ação Direta de Inconstitucionalidade n. 3510, que questionou a constitucionalidade da Lei n. 11.105/05 quanto ao uso de células-tronco embrionárias em pesquisas científicas, e a Arguição de Descumprimento de Preceito Fundamental n. 54, que tratou sobre a antecipação terapêutica do parto de fetos anencéfalos. A abordagem do conceito de razões públicas, notadamente relacionado aos argumentos religiosos que adentam ao debate, também será feita nesse ponto. O objetivo final é demonstrar a defasagem na legislação brasileira, que não pune e não coíbe a prática, mas impede que a mulher possa exercer com liberdade e segurança a totalidade de seus direitos sexuais e reprodutivos.Abstract: The prohibition on abortion is a way of dominating the woman's body and it derives from religious elements, the idea of sin, the notion of sacredness of human life, all translated into the defense of the right of being born and the protection of the unborn child as juridical arguments. The control of que woman's body is also a product of patriarchy, the form of woman's domination by the masculine figure. The feminist movement works, since its begging, on the acquisition of sexual and reproductive rights, with emphasis on this theme since the 1960's. Abortion is a crime in Brazil, referred in the Penal Code, on articles 124 and following and punished by detention. However, this prevision has no effectiveness, since there are so few convictions based on this action. The criminalization leads women that want to abort to underground clinics, putting their health and lives in danger, besides the potential risk of criminal prosecution. The objective of this research is to examine the arguments on the juridical treatment of abortion in some of its sides: a) initially, it will verse about the Christianity's female stereotypes, opposing the models of "saint" and "sinner" given to women; will address the reflections of woman's submission on philosophy and the beginning of a new way of thinking about women, with a rupture with the logic of domination; it will go to the analysis of feminist's vindications as sexual and reproductive rights until it reaches the moral defences of abortion; b) the second part aims to portray the Brazilian reality, starting on state secularism and the religious influence on politics since the Constituent National Assembly, going through the presence of the feminist movement on the vindication of liberty and autonomy over woman's own body and arriving on the legislative propositions related to abortion; will verse, still on this theme, about the Supreme Court's decision in Roe v. Wade, that resulted on the decriminalization of abortion in the United States; c) the final part of the research will converse about the Brazilian Supreme Court that went over themes relates to abortion, and about the public court hearings that informed the decisions. The analysed cases will be de Unconstitutionality Action ("Ação Direta de Inconstitucionalidade") n. 3510, that questioned the constitutionality of the Law n. 11.105/05 about the use of stem cells on scientific researches, and the Complaint of Breach of Fundamental Precept ("Arguição de Descumprimento de Preceito Fundamental") n. 54, that addressed the possibility of therapeutical anticipation of child birth when the fetus has anencephaly. The approach on the concept of public reasons, specially related to religious arguments that enter the debate, will also be made on this part.
