Ao lado dela, entretanto, não lhe podem ser negadas demandas autônomas, proponíveis antes da instauração do processo executivo, durante seu curso ou, principalmente, após seu encerramento; de modo especial nas hipóteses em que, em se tratando do processo de cognição, caberia ação rescisória contra a sentença {lato sensu) nele proferida, já que, não havendo julgamento no próprio processo de execução, não há sentença de mérito que possa ser objeto de rescisão (Cód. de Proc. Civil, art. 485, caput).Abstract: The thesis for now sustained is that the supposed debtor doesn’t just have the embargoes against the execution to defend himself; these are just a - and the most efficient - of the actions that he can use for so much.
