INNOVATION IN PUBLIC POLICIES: ENVIRONMENTAL LEGISLATION AS A TOOL OF TECHNOLOGICAL MODERNIZATION - THE CASE OF THE PORTO ALEGRE INFOVIA

Resumo: It can be stated with no mistaking that the lack of resources is a complaint shared by all governments, and it is just a step from that to the justification of impotence and inaction face to society's demands, what often results in an effective public policies vaccum. Therefore, the study and disclosure of successful experiences in the use of alternative tools to the formulation and implementation of public policies is justified, as in the case of the power of regulation and reglamentation of the public utilities provided by the private sector by means of state concession. This paper, written as a descriptive, analytical, and critical case study based on secondary data complemented by interviews, presents the experience of the Porto Alegre City Hall which, from an enlarged understanding of environmental legislation, has framed a new regulatory mark to the use of urban soil and subsoil, managing, thus, to conceive and project the growth and development of the city.

Por lo tanto, se justifica el estudio y la divulgación de las experiencias bien sucedidas en el uso de instrumentos alternativos para la formulación y implementación de políticas públicas, a ejemplo del poder de regulación y regulamentación de los servicios de utilidad pública prestados por el sector privado mediante concesión del Estado. Este trabajo, escrito en la forma de un estudio de caso descriptivo, analítico y crítico, com base en datos secundários complementados con entrevistas, presenta la experiencia de la Prefeitura (ayuntamiento) Municipal de Porto Alegre que, a partir de un entendimiento ampliado de la legislación ambiental, estruturó un nuevo marco regulatorio para el uso del suelo y del subsuelo urbano, conseguiendo, así, proyectar y planear el crecimiento y el desarrollo de la ciudad.A falta de verbas, pode-se afirmar sem margem de erro, é lamento comum a todos os governos e, daí à justificativa de impotência e inação frente às inúmeras demandas que lhe chegam da sociedade, é um passo, o que não raro resulta em um efetivo vácuo de políticas públicas. Portanto, justifica-se o estudo e a divulgação das experiências bem sucedidas no uso de instrumentos alternativos para a formulação e implementação de políticas públicas, a exemplo do poder de regulação e regulamentação dos serviços de utilidade pública prestados pelo setor privado mediante concessão do Estado.
