A Hermeneutic-linguistic Critique of Robert Alexy's Concept of Legal Interpretation

Resumo: The purpose of this study is to criticize Robert Alexy’s concept of legal inerpretation grounded in a few assumptions of philosophical hermeneutics, philosophy of language and contemporary legal linguistics. After delineate the fundamental aspects of this concept of interpretation, inconsistencies founded in it will emerge, along with, several theoretical repercussions of these contradictions in the thinking model developed by the author and, ultimately, certain practical consequences of these findings. Regarding the last point, the focus will be on the indefensibility of Alexy’s concept of norm, specially his concept of legal rule and the possible consequences of the application of this concepts by the judiciary. Judicial Creation of Law.O presente trabalho se ocupa de uma crítica ao conceito de interpretação jurídica de Robert Alexy a partir de alguns pressupostos da hermenêutica filosófica e da filosofia da linguagem e linguística jurídica contemporâneas. Após delinear os aspectos fundamentais deste conceito de interpretação, serão apresentadas incongruências nele encontráveis, bem como algumas repercussões teóricas destas contradições no modelo de pensamento desenvolvido pelo autor e, por fim, determinadas consequências práticas destes achados. Quanto ao último ponto, a análise se centrará na indefensabilidade do conceito de norma jurídica e, especialmente de regra jurídica por ele propostos e em suas possíveis consequências para a atividade jurisdicional.
