Resumo: The Ancien Regime distinguished for its plurality of norms and personal status. Nevertheless, the political constitutions emerged after the revolutions at the end of the XVIIIth century tried to stablish the freedom and equality for the new citizens, but, in this way, these rights collided with a different social reality, where the diversity was subordinated to the idea of unity.Therefore, the following work addresses the debate about the legal status of africans (castas) during the first years of the mexican constitutionalism. In this way, it pretends to understand the limits and tensions of freedom and equality between 1821 and 1824.

No entanto, as Constituições políticas surgidas das revoluções do final do século XVIII tentariam estabelecer a liberdade e igualdade dos novos cidadãos, ainda que neste caminho esses direitos colidissem com uma realidade social que subordinava a diversidade a ideia de unidade. Por conseguinte, o seguinte trabalho aborda o debate sobre o estatus jurídico dos afrodescendentes (castas) durante os primeiros anos do nascente constitucionalismo mexicano. Desta forma, pretende-se conhecer os alcances, limites e tensões dos direitos de liberdade e igualdade entre 1821 e 1824.
