Resumo: The objective of this study was to consider the concept of citizenship within the mental health services of the Brazilian Public Health System. A brief summary was made of the current and pending legislation that controls the mental health services. The authors also discussed about how citizenship is practiced within the mental health services, including the role of health workers that deal with mentally ill persons.

Para su elaboración se hizo un ligero histórico de la legislación brasileña, con referencia a la implantación del Sistema Unico de Salud y de los proyectos de ley que estan tramitando en el Senado Federal. En un segundo momento, se buscó contextuar como el exercício de la ciudadania ocurre dentro de los servicios de salud y qual es el papel de los trabajadores en ocupar los espacios de la ciudad, junto con los portadores del sufrimiento psiquico.Este estudo buscou refletir sobre como o conceito abstrato de cidadania deve ser construído no interior dos serviços de saúde mental. Para sua consecução levantou-se um breve histórico da legislação brasileira, concernente à implantação do Sistema Único de Saúde e dos projetos de lei em tramitação no Senado Federal.
