Analysis of state decrees on electronic document management systems considering archival governance

This article deals with the analysis of the decrees of the federative entities regarding the use of the digital medium for the management of administrative documents, from the perspective of archival governance. The advances and limitations placed on them and the impact of these legal frameworks for the production, preservation and access of digital archival documents of the state public administration were considered. It is a documentary and applied research, with a qualitative and quantitative approach, with a descriptive character. The use of computerized means for the management of administrative processes by the states is established by the federative entity itself in the use of its attributions, based on decrees or laws that define the state structure to produce, capture, process, preserve, describe and access digital documents. The survey of state and federal decrees was carried out in two stages: the first, using the Google search engine, and the second, through an information request in the Electronic Citizen Information System (e-CIS). The theoretical foundation was structured considering archival governance with an emphasis on norms, standards and recommendations established by the National Council of Archives (Conarq). As a result, a departure from archival principles was perceived in the analyzed decrees, which could compromise, for example, the presumption of authenticity, the legal-evidence character and the integrity of archival documents, putting at risk access, transparency and the preservation of the state's administrative memory for future generations.
