Resumo: | “Is transitional justice a linear process?” – This paper aims to provide an answer to this interrogative, outlining the impacts that transitional justice, as a complex and nonlinear process, can play in a “post-conflict” context, characterized by the vulnerability of certain social actors. This paper discusses some problematics related to the reconstruction of a “collective memory”, its associated bias and the perverse effects in distorting the “positive principles” and objectives that constitute the basis of transitional justice-related mechanisms. It describes the public policies of a contemporary Tunisia in transition as a key to understand the reactions of heterogeneous actors (ex. civil society, militaries, third parties/international actors) in facing institutional and social transitions on the short and long-term. |

Ce travail aborde les problématiques liées à la reconstruction d’une « mémoire collective », les distorsions et les effets pervers qui peuvent interférer dans ces phases, affectant les « principes positifs » et les objectifs sur lesquels s’axent les mécanismes de justice transitionnelle. Ce travail décrit les politiques publiques mises en place auprès d’une Tunisie contemporaine en transition, afin de comprendre les réactions d´acteurs hétérogènes (p. ex. société civile, militaires, tierces parties/acteurs internationaux) pour faire face à des transitions institutionnelles et sociales sur la courte et longue-période.“A justiça transicional é um processo linear?” – A busca por uma paz duradoura por meio da justiça transicional e o papel da memória: Um olhar sobre a Tunísia contemporânea busca responder essa questão, delineando os impactos que um processo de justiça transicional, complexo e não-linear, pode ter em um contexto de “pós-conflito” caracterizado pela vulnerabilidade de certos atores sociais. O artigo discute algumas problemáticas relacionadas à reconstrução de uma “memória coletiva”, seus vieses e efeitos perversos na distorção dos “princípios positivos” e objetivos que constituem a base dos mecanismos relacionados à justiça transicional.
