Criminal Justice and Gender: The Flow of Drug Trafficking in Montes Claros, Minas Gerais, from 2009 to 2014

Resumo: The aim of this article is to understand how gender patterns influence the processing of crimes foreseen in the 2006 law nº 11.343 in the city of Montes Claros, north of Minas Gerais. The analysis of all occurrences related to the drug law between 2009 and 2014 indicate that gender influences the classification of the crime as trafficking instead of use but does not interfere in the chances of transforming this police occurrence into criminal process. Interviews with operators of the criminal justice system reinforced the perspective of the bandit love, since they pointed out the men as the main cause of the involvement of women in drug trafficking.

A análise das ocorrências relacionadas à lei entre 2009 e 2014 indicou que o gênero do sujeito abordado pela polícia influi na classificação do delito como tráfico, em detrimento de uso, mas não interfere nas chances de a ocorrência policial se tornar um processo penal.
