Resumo: | In this paper, I analyze how Carl Schmitt defines the political nature of constitutional jurisdiction from his works written in the final years of the Weimar Republic: "The Concept of the Political" and "The Guardian of the Constitution". I try to contrast his answers with some contemporary approaches. In particular, his thesis on the difference between "high politics" and "secondary politics" are indispensable to understand his defense of a conception of the Rule of Law respectful of the "separation of powers" and his position on the judicial creation of law within the ordinary jurisdiction. Properly understood, his theses are extremely pertinent in contexts marked simultaneously by political-institutional crises and intense judicialization of politics. |
