The present work reflects on possible contradictions between the Right to Intellectual Property and the Right to Health, especially with regard to patents granted to medicines. This work seeks to analyze with a certain calmness and depth the abovementioned rights, their origin and legal foundation over time, both national and international, in order to punctuate the irrefutable importance of both, as well as demonstrate that they should not be seen as opponents in no respect. Once this has been done, it will be tried to demonstrate, through analysis of legislation and international research pertinent to the subject, that the respect and improvement of the right to pharmaceutical Industrial Property unquestionably contributes to the due and wider access to health. To this end, the following topics, definitions of intellectual and industrial property, as well as the evolution of these rights in the Brazilian legal order, the peculiar importance of such a guarantee for the pharmaceutical industry, and a brief explanation on the right to health and relations positive and negative effects that occur among the aforementioned principles.
