Bairro Mãe Luiza: uma abordagem "legal" sobre a realidade local

Resumo: This study discusses the urban legislation and its implications on socio- dynamics of the city, having as reference the Neighborhood Mãe Luiza in Natal, capital of Rio Grande do Norte . Mãe Luiza has amenities due to its geographical location that turn it into a desirable and coveted by area real estate market. Thus, from the Master Plan for Christmas 1994s, establishing special zoning areas of the city, both in terms of social interest, such as environmental protection. The work focused on the Special Zone of Social Interest (AEIS), governed by Law No. 4,663, dated July 1995, which provides for the use of land, boundaries and urban requirements of Mãe Luiza district 31 as well as the stated environmental protection corresponding to will the dunes adjacent to the lighthouse, proposed by the Master Plan of the city as the Environmental Protection Zone area 10 area. Accordingly, we investigated the evolution of the occupation and district Mae Luiza, its importance as a Special Area of Social Interest (AEIS), the impact of those rules on how to use and occupation of the neighborhood. We defined the overall objective to analyze the process of use and occupation of land in the neighborhood Mae Luiza, from its setting as AEIS and specific objectives, analyze historical aspects of the formation of the district, to identify events that marked their spatial evolution; review the law of use and occupation of the neighborhood and compare the requirements of that law with the social and spatial reality of the neighborhood. The analysis on the problem at hand is based on authors like Carlos (2000), Ribeiro (1997), Santos (1999), Duarte (2011), Bentes and Trindade (2011), Piglet (1978 ), Delgado ( 1992) and Fernandes (2000 ) that discuss : transformations in space , the production of housing , urban legislation; cities held ; Special Areas of Social Interest and evolution of urban space , especially the Mãe Luiza neighborhood. The methodology was based on three different times as: 1 - Bibliographies in books, articles, monographs, theses and dissertations; 2 - Documentary Survey Laws, decrees, annuals, master plans, etc., in addition to direct field survey, which gave support for the mapping of the study area and the photographic record; 3 - application of direct interviews with residents of the neighborhood and Mae Luiza people in the public sector. The Quarter Mãe Luiza originated in the 1940s, being made, even today, by a predominantly low-income population. Associated with this aspect, its geographical location in an area of dune formation was essential for recognition as an AEIS. Such recognition involved widespread social mobilization, given that the population feels threatened by the real estate market, whose shares already surround the territory of the district. Despite the legislation, it was found that there were cases of rape , especially as they relate to the standards regulating the construction of buildings. Finally , the survey revealed that the definition of the neighborhood as a AEIS produced different views among residents . Some consider that the legislation is a delay for the neighborhood because discipline and establishes restrictions on the use and occupation of land and if it were modified could attract people with higher purchasing power, so the power would channel public benefits to the community. Others perceive it as an instrument that ensures the conditions of stay of residents on site, just to restrict and regulate the action of the agents that produce the city space. Upon the foregoing, it is considered that the study of the district Mãe Luiza, the prospect of a legal approach on local reality, reveals the complexity involved in the construction of urban space, permeated by contradictions and conflicts. In the case of Mãe Luiza in the fight and surveillance is constant, sometimes in relation to the voracity of the housing market , now as regards the failure or inefficiency of the state, assumes sharpening the sense of belonging and the desire to protect the history, and memory space, which for locals means your place.

Mãe Luiza possui amenidades decorrentes de sua localização geográfica que a transformam em uma área desejável e cobiçada pelo mercado imobiliário. Considerando o Plano Diretor de Natal de 1994 que instituiu os espaços especiais ao zoneamento da cidade, tanto em termos de interesse social, como de proteção ambiental, o trabalho focalizou o bairro Mãe Luiza, Área Especial de Interesse Social (AEIS) esta área é regida pela Lei nº 4.663, de 31 de julho de 1995, que dispõe sobre o uso do solo, limites e prescrições urbanísticas do bairro, bem como a proteção ambiental definida para á área correspondente ao cordão dunar adjacente ao farol, que no Plano Diretor da cidade corresponde a Zona de Proteção Ambiental 10. Nesse sentido, investigou-se a ocupação e evolução do Bairro Mãe Luiza; sua importância enquanto Área Especial de Interesse Social (AEIS); as repercussões desta regulamentação sobre a forma de uso e ocupação do solo do bairro. Definiu-se como objetivo geral analisar o processo de uso e ocupação do solo no Bairro Mãe Luiza, a partir de sua configuração como AEIS e, como objetivos específicos, analisar aspectos históricos da formação do bairro; identificar eventos que marcaram sua evolução espacial; avaliar a lei de uso e ocupação do solo do bairro e comparar as prescrições da referida lei com a realidade socioespacial do bairro. A análise sobre a problemática em pauta está fundamentada em autores como Carlos (2000); Ribeiro (1997); Santos (1999); Duarte (2011); Bentes e Trindade (2011); Leitão (1978); Delgado (1992) e Fernandes (2000) que discutem as transformações no espaço; a produção da moradia; a legislação urbana; as cidades sustentavam; as Áreas Especiais de Interesse Social e a evolução do espaço urbano, principalmente do bairro Mãe Luiza. A metodologia pautou-se em três momentos distintos como: 1 - Levantamento bibliográfico em livros, artigos, monografias, dissertações e teses; 2 – Levantamento documental em Leis, decretos, anuários, planos diretores etc, além da pesquisa direta de campo, que deram suporte para o mapeamento da área de estudo e o registro fotográfico; 3 – aplicação de entrevista direta com moradores do bairro Mãe Luiza e pessoas do setor público. O bairro Mãe Luiza originou-se na década de 1940, sendo constituído, ainda hoje, predominantemente por uma população de baixa renda. Associado a esse aspecto, sua localização geográfica em uma área de formação dunar, foi fundamental para o reconhecimento como uma AEIS. Tal reconhecimento envolveu forte mobilização social, tendo em vista que a população se sente ameaçada pelo mercado imobiliário, cujas ações já circundam o território do bairro. A despeito da legislação vigente, constatou-se a existência de casos de violações, especialmente no que se referem às normas que disciplinam a construção das edificações. Por fim, a pesquisa revelou que a definição do bairro como uma AEIS produziu visões diferenciadas entre os moradores. Alguns consideram que a legislação representa um atraso para o bairro porque disciplina e estabelece restrições ao uso e ocupação do solo e, caso fosse modificada poderia atrair pessoas de maior poder aquisitivo, de modo que o poder publico canalizaria benefícios para a comunidade. Outros a percebem como um instrumento que assegura as condições de permanência dos moradores no local, justamente por restringir e disciplinar a ação dos agentes que produzem o espaço citadino. Mediante o exposto, considera-se que o estudo sobre o bairro Mãe Luiza, na perspectiva de uma abordagem legal sobre a realidade local, revela a complexidade que envolve a construção do espaço urbano, perpassada por contradições e conflitos.
