Resumo: The purpose of this research is to understand how the imperial elite tried to solve the serfdom issue based on the articulation and elaboration of an emancipation project that would guarantee the maintenance of its privileges and determine the fate of emancipated black people, whether in political clashes, or in narratives elaborated outside institutional spaces. Aligning emancipation, maintenance of privileges and social order seems to have been the center of the debates and proposals that resulted in the law of September 28, 1871. The narratives about emancipation and the possibilities of reinventing the social order were diverse and many scenes resulted in abolition. Debates about the conduct of the Free Womb law jumped the walls of parliament and accessed the courts, the streets, homes, the press and literature. Men and women felt that they had something to say and they did so, articulating themselves so that their ideas, projects and intentions were known and, perhaps, could interfere, influence or manipulate the institutional political project. This thesis seeks to cover part of the path between the discussion about the elaboration of the law and its enactment, even entering the alleys and alleys of these narratives: the writings that indicate how much the idea of emancipation disturbed the social imaginary of supporters of slavery (mostly landowners and enslaved people) and their rage for power and guarantee of maintaining the privileges based on the slave structure. For this, the research that I present was sewn from the presentation to the Parliament of emancipation projects in 1865, from the uneasiness generated with the official proposal of emancipation launched by D. Pedro II and from the ambiguity between the discomfort of being the last slave- owning country in the Americas and resistance to enact abolition. In this perspective, I defended, along the lines that follow, the premise that the debate around emancipation was designed to guarantee the maintenance of the social and economic privileges of the property- owning elite and social control over freedmen and na?ves through legislation, based on the mentality that formalized racism as a structural element of Brazilian society. If the imperial political elite discussed, narrated and questioned about the ways to emancipate the enslaved woman's womb, during the years that preceded the implementation of the gradual emancipation project, it also discussed, narrated and questioned about abolition and its effects , to the point of forging a historical memory of that period based on the discourse of glorification of its deeds.

Os debates acerca da condu??o da lei do Ventre Livre saltaram os muros do parlamento e acessaram os tribunais, as ruas, as casas, a imprensa e a literatura. Homens e mulheres sentiram que tinham algo a dizer e assim o fizeram, articulando- se para que suas ideias, projetos e inten??es fossem conhecidos e, qui??, pudessem interferir, influenciar ou manipular o projeto pol?tico institucional. Esta tese busca percorrer parte do trajeto entre a discuss?o sobre a elabora??o da lei e sua promulga??o, adentrando, inclusive, as vielas e os becos dessas narrativas: os escritos que indicam o quanto a ideia de uma emancipa??o perturbou o imagin?rio social dos apoiadores da escravid?o (propriet?rios de terras e de escravizados, em sua maioria) e a sua sanha de poder e garantia de manuten??o dos privil?gios pautados na estrutura escravista. Para isso, a pesquisa que apresento foi se costurando a partir da apresenta??o ao Parlamento de projetos de emancipa??o em 1865, da inquieta??o gerada com a proposta oficial de emancipa??o lan?ada por D. Pedro II e da ambiguidade entre o inc?modo de ser o ?ltimo pa?s escravista nas Am?ricas e a resist?ncia em efetivar a aboli??o. Nesta perspectiva, defendi nas linhas que seguem a premissa de que o debate em torno da emancipa??o foi pensado de forma a garantir a manuten??o dos privil?gios sociais e econ?micos da elite propriet?ria e do controle social sobre libertos e ing?nuos atrav?s da legisla??o, alicer?ados na mentalidade que formalizou o racismo como elemento estrutural da sociedade brasileira. Aligning emancipation, maintenance of privileges and social order seems to have been the center of the debates and proposals that resulted in the law of September 28, 1871. The narratives about emancipation and the possibilities of reinventing the social order were diverse and many scenes resulted in abolition. Debates about the conduct of the Free Womb law jumped the walls of parliament and accessed the courts, the streets, homes, the press and literature. Men and women felt that they had something to say and they did so, articulating themselves so that their ideas, projects and intentions were known and, perhaps, could interfere, influence or manipulate the institutional political project. This thesis seeks to cover part of the path between the discussion about the elaboration of the law and its enactment, even entering the alleys and alleys of these narratives: the writings that indicate how much the idea of emancipation disturbed the social imaginary of supporters of slavery (mostly landowners and enslaved people) and their rage for power and guarantee of maintaining the privileges based on the slave structure. For this, the research that I present was sewn from the presentation to the Parliament of emancipation projects in 1865, from the uneasiness generated with the official proposal of emancipation launched by D. Pedro II and from the ambiguity between the discomfort of being the last slave- owning country in the Americas and resistance to enact abolition. In this perspective, I defended, along the lines that follow, the premise that the debate around emancipation was designed to guarantee the maintenance of the social and economic privileges of the property- owning elite and social control over freedmen and na?ves through legislation, based on the mentality that formalized racism as a structural element of Brazilian society. If the imperial political elite discussed, narrated and questioned about the ways to emancipate the enslaved woman's womb, during the years that preceded the implementation of the gradual emancipation project, it also discussed, narrated and questioned about abolition and its effects , to the point of forging a historical memory of that period based on the discourse of glorification of its deeds.
