Resumo: | he present research addresses the public policies for the creation and management of Conservation Units (CU´s), regulated by Law 9.985/2000, through which the National System of Conservation Units (in Portuguese, SNUC-Sistema Nacional de Unidades de Conservação) was established at Union, State and Municipality levels. According to the Ministry of Environment, there are more than 800 units in total in the two regions, 56.5% of which are under federal administration, 40% under state administration and only 3.5% under municipal administration, covering 15% of the country's continental area and 26% of the marine area under special protection. The management models currently used in specific organs are analyzed, as well as the structure and the organizational, political-administrative and institutional system adopted, which are reflected on the dynamics of territorial management practiced in the 824 Conservation Units of various categories, magnitudes and typology of natural and socio-environmental areas in Brazil´s Legal Amazon. Differences in the institutional and political arrangements, which are deployed and operated in the Conservation Units, were identified and classified, with the purpose of critically characterizing and confronting each management model adopted and the infrastructural and superstructural apparatus at different levels of environmental and governance territorial. The research starts from a hypothesis that focuses on the socio-spatial mechanisms and dynamics that generate differentiation in the territorial organization, according to the environmental management models practiced by the State in its spheres of government, and an incipient participation of the municipal sphere in the national CU´s system, within the political arrangement institutional decentralization of environmental policies. The procedures used in the present research were based on specific bibliography, internal documents and published papers, on primary field data collection, through sampling of the study universe, on statistical and cartographic secondary data. The theoretical support made use of the ontology of geographic space as a system of objects and a system of actions in a hybrid geographic space, according to the framework presented by Milton Santos (1977), who applies the concept of dialectical and socio-spatial formation, elaborating a theory which state that a society becomes concrete through the space that it produces in terms of structure, process, function and form. An approach about the concepts of territory and territoriality was included, which configure conservation units as specially protected territorial spaces. Philosophical anchorage in Foucault was sought, according to studies developed in the 1990s, referring to the concept of governmentality, which is a theoretical tool that, according to the author, translates a set of institutions, procedures, analyses, reflections, calculations and tactics that allow to exercise a specific and complex form of power that is government. Throughout the work, the theoretical-conceptual and methodological basis was built, the specific delineation of the object proposed for study, and postulated, based on structured hypotheses, the thesis that currently Brazil does not practice a national system as proposed by SNUC, but a system at the federal level that can be called “SIFUC”. Based on this thesis, the feasibility of adjusting state and municipal systems compatible with the SNUC is exposed, fostering its creation in states and municipalities where they do not yet exist, in articulation with the governance of the territory at different scales of inter-institutional planning and intersectoral, democratically and efficiently. In conclusion, there is a need for a national system of protected areas that, based on governance, promotes articulation with its set of CU´s and with other protected areas, with a view to achieving the effective protection of biodiversity, ecosystem services and the way of life of the residents of these Units and their areas of influence. |

Según el Ministerio del Medio Ambiente (MMA), de las más de 800 Unidades en las dos regiones, el 56,5% se encuentran bajo administración federal, el 40% estatal y solo el 3,5% bajo la gestión municipal, abarcando el 15% del área continental del país y el 26 % del área marina bajo protección especial. Son analizados los modelos de gestión vigentes en los órganos específicos, la estructura y el aparato organizacional, político-administrativo e institucional adoptado que, a su vez, generan reflexiones en la dinámica de la gestión territorial practicada en las 824 Unidades de conservación de diversas categorías, magnitudes y tipología de espacios naturales y socioambientales en la Amazonía Legal. Fueron identificadas y clasificadas las diferencias en el arreglo institucional y político que implementan, instrumentaliza y operacionaliza las Unidades de Conservación, con el objetivo de caracterizar y confrontar, críticamente cada modelo de gestión adoptado y el aparato infraestructural y superestructural en los diversos niveles de gobernanza ambiental y territorial. Se partió de la hipótesis que focaliza los mecanismos y dinámicas socioespaciales generadoras de diferenciación en la organización territorial, en función de los modelos de gestión ambiental practicados por el Estado en sus esferas de gobierno, y una participación incipiente de la esfera municipal en el sistema nacional de UCs, dentro del arreglo político institucional de descentralización de las políticas ambientales. Los procedimientos de la investigación están basados en bibliografía específica, documentos internos e informes divulgados, en la recolección de datos primarios en el campo, mediante el muestreo del universo de estudio, y en datos secundarios estadísticos y cartográficos. El soporte teórico recurrió a la ontología del espacio geográfico como un sistema de objetos y un sistema de acciones en un espacio geográfico híbrido, de acuerdo con el marco de referencia presentado por Milton Santos (1977), quien aplica el concepto de formación socioespacial dialéctica, elaborando la teoría de que una sociedad se concretiza a través del espacio que produce en términos de estructura, proceso, función y forma. Se incluyó el abordaje sobre los conceptos de territorio y territorialidad, que configuran las unidades de conservación como espacios territoriales especialmente protegidos. Se buscó el anclaje filosófico en Foucault, de acuerdo con estudios desarrollados en la década de 1990 y referentes al concepto de gubernamentalidad, herramienta teórica que, según el autor, traduce un conjunto de instituciones, procedimientos, análisis, reflexiones, cálculos y tácticas que permiten ejercer una forma de poder específica y compleja como lo es el gobierno. A lo largo del trabajo, fue construida la base teórico-conceptual y metodológica, la delimitación específica y concreta del objeto propuesto para el estudio, y postulada, con base en las hipótesis estructuradas, la tesis de que actualmente Brasil no practica un sistema nacional como es propuesto por el SNUC, sino un sistema postulado a nivel federal que se puede denominar “SIFUC”. A partir de esta tesis, se diseña la viabilidad de ajustar los sistemas estatales y municipales compatibles con el SNUC, y fomentar su creación en Estados y municipios donde aún no existen, de forma articulada con la gobernanza del territorio en diferentes escalas de planificación interinstitucionalidad e intersectorial, democrática y eficiente. Se concluye que hay la necesidad de un sistema nacional de conservación que, a partir de la gobernanza, promueva la articulación con su conjunto de UCs y con las demás áreas protegidas, con el objetivo de alcanzar la protección efectiva de la biodiversidad, de los servicios ecosistémicos y de los modos de vida de los residentes de estas Unidades y sus áreas de influencia.Este estudo aborda as políticas públicas para criação e gestão de Unidades de Conservação (UCs), reguladas pela Lei 9.985/2000, que instituiu o SNUC-Sistema Nacional de Unidades de Conservação incidente nas esferas da União, Estado e Município. Conforme o Ministério do Meio Ambiente (MMA), das mais de 800 Unidades, 56,5% estão sob administração federal, 40% estadual e apenas 3,5% sob gestão municipal, abrangendo 15% da área continental do país e 26% da área marinha sob proteção especial. São analisados os modelos de gestão vigentes nos órgãos específicos, a estrutura e o aparato organizacional, político-administrativo e institucional adotados que, por sua vez, geram reflexos na dinâmica da gestão territorial praticada nas 824 Unidades de conservação de diversas categorias, magnitudes e tipologia de espaços naturais e socioambientais na Amazônia Legal. Os procedimentos da pesquisa se basearam em bibliografia específica, documentos internos e relatórios divulgados, além da coleta de dados primários em campo, além de dados secundários estatísticos e cartográficos. O suporte teórico recorreu à ontologia do espaço geográfico enquanto sistema de objetos e sistema de ações em um espaço geográfico híbrido, de acordo com o arcabouço apresentado por Milton Santos (1977), bem como a categoria território ancorada na Geografia Socioambiental. Ao longo do trabalho, foi construída a base teórico-conceitual e metodológica, ou seja, delineamento específico e concreto do objeto proposto para estudo, e postulada, com base nas hipóteses estruturadas, a tese de que atualmente o Brasil não pratica um sistema nacional como proposto pelo SNUC, mas um sistema postulado em nível federal que se pode denominar “SIFUC”. Desenha-se a partir desta tese a viabilidade de ajustar sistemas estaduais e municipais compatíveis com o SNUC e fomentar a sua criação em estados e municípios em que ainda não existam, de forma articulada com a governança do território nas diferentes escalas de planejamento interinstitucional e intersetorial, democrática e eficiente. A tese aqui defendida indicou que o sistema de gestão do SNUC na Amazônia precisa aumentar a sua capacidade de adaptação para modernizar e promover os ajustes necessários nos seus arranjos governança (tomada de decisão) e no seu padrão de interação institucional transescalar para que as UCs funcionem de forma eficiente e equitativa, no intuito de transcender os conflitos relativos ao uso dos bens comuns por diferentes usuários nas áreas onde são instaladas, garantindo o aproveitamento do rendimento da biodiversidade pelas atuais e futuras gerações. Além disso, verificou-se que os insumos necessários à gestão das UCs, como recursos humanos e financeiros, não estão compatíveis com as necessidades desses territórios. Por fim, foi identificada na governança do SNUC uma articulação insuficiente entre os atores envolvidos na gestão de UCs, decorrente de coordenação incipiente, baixa cooperação e frágil comunicação. Podemos concluir que tanto o processo de “Snuczação” trazido nesta tese (de reprodução do SNUC pelos sistemas estaduais de UCs) quanto a não municipalização da gestão ambiental representam o modelo trazido a partir da CF de 1988, que redefiniu o papel institucional que os diferentes níveis de poder (União, Estados e Municípios) exercem no ordenamento jurídico alicerçado no pacto federativo e sua prerrogativa da descentralização da prestação dos serviços públicos pelo Estado. The theoretical support made use of the ontology of geographic space as a system of objects and a system of actions in a hybrid geographic space, according to the framework presented by Milton Santos (1977), who applies the concept of dialectical and socio-spatial formation, elaborating a theory which state that a society becomes concrete through the space that it produces in terms of structure, process, function and form. An approach about the concepts of territory and territoriality was included, which configure conservation units as specially protected territorial spaces. Philosophical anchorage in Foucault was sought, according to studies developed in the 1990s, referring to the concept of governmentality, which is a theoretical tool that, according to the author, translates a set of institutions, procedures, analyses, reflections, calculations and tactics that allow to exercise a specific and complex form of power that is government. Throughout the work, the theoretical-conceptual and methodological basis was built, the specific delineation of the object proposed for study, and postulated, based on structured hypotheses, the thesis that currently Brazil does not practice a national system as proposed by SNUC, but a system at the federal level that can be called “SIFUC”. Based on this thesis, the feasibility of adjusting state and municipal systems compatible with the SNUC is exposed, fostering its creation in states and municipalities where they do not yet exist, in articulation with the governance of the territory at different scales of inter-institutional planning and intersectoral, democratically and efficiently. In conclusion, there is a need for a national system of protected areas that, based on governance, promotes articulation with its set of CU´s and with other protected areas, with a view to achieving the effective protection of biodiversity, ecosystem services and the way of life of the residents of these Units and their areas of influence. |
