Patenteamento na indústria farmacêutica no Brasil : tendências, oportunidades e estratégias

Resumo: Technological innovation is an important instrument of competitiveness in the face of new market requirements for sustainable enterprises. In this sense, it can be used strategically not only the advantage to reduce competition from the differentiation of a new product, but also to position domain dialing in profitable and competitive markets. Therefore, it is essential to protect the new assets in various industrial sectors. Among the hedging instruments relating to intellectual property rights are patents, which provide many competitive advantages to its owner, not allowing others to use, distribute, import or sell without his consent. In the pharmaceutical sector, where the products produced to solve many health problems of the population result from expensive processes, patents become an incentive for innovation. Considering the economic and social importance of patenting activity and the pharmaceutical industry for the country, this paper conducted a systematic analysis of patenting the Brazilian pharmaceutical industry, evaluating patent applications filed at INPI basis by industry-leading companies and analyzing indicators for categorization of trends and strategies. The results mainly showed the recent growth of the domestic pharmaceutical industry, as cycle of technological life, the analytical strategic behavior of EMS and Eurofarma companies, the defender, Chemical Union, and the prospector, the Aché and Hypermarcas and market opportunities for investments of Brazilian pharmaceutical companies in oncology areas and allergic.

Nesse sentido, pode ser utilizada estrategicamente não apenas como vantagem para a redução da concorrência a partir da diferenciação de um novo produto, mas também para marcação de domínio de posição em mercados rentáveis e competitivos. Por isso, torna-se imprescindível a proteção dos novos ativos em diversos setores industriais. Dentre os instrumentos de proteção relativos aos direitos de propriedade intelectual estão as patentes, as quais conferem diversas vantagens competitivas a seu titular, não permitindo que terceiros usem, distribuam, importem ou vendam sem o seu consentimento. No setor farmacêutico, em que os medicamentos produzidos para solucionar diversos problemas de saúde da população resultam de processos caros, as patentes se tornam um incentivo para as inovações. Considerando a relevância econômica e social da atividade de patenteamento e da indústria farmacêutica para o país, o presente trabalho realizou uma análise sistêmica do patenteamento na indústria farmacêutica brasileira, avaliando os pedidos de patentes depositados na base do INPI pelas empresas líderes do segmento e analisando indicadores para categorização das suas tendências e estratégias.
