The present work aimed to investigate about the “enemy” and your relation with the National Doctrine Security (NDS), in the period covered by the Brazilian Military Dictatorship. Through a literature review, NDS and the internal enemy figure are analyzed, especially when the “threat” Is triggered by “imminent revolutionary war”. Inevitably, because it’s the modification of the Authoritarian State of 1964, it was required to discuss about the events that caused and legitimized the takety of power by the armed forces, lead by example of the João Goulart Government and its basic reforms. In the following, it investigates the criminalization process that were submitted the PCB members, considering that the formal control agencies were mobilized to stalk, control and neutralize the enemies and the subversives listed by the National Doctrine Security. The enemy becomes an “open criminal clause”, considering that any citizen, towards an initiated inter war, it can become a target of the repressive state polices
