The purpose of this study was to understand the process of appropriation of the public fund by capital and the refutations to the Brazilian Social Security budget from the functionality of the Modern State, guided by neoliberal principles, in the context of the structural crisis of the capital system. A bibliographical research guided by Marx's social theory was constructed. To do so, the first step was to expose the conception of State undertaken in the reflections of the study, then to understand the context of the emergence of the Modern State as a social product in which the bourgeoisie is used to organize itself as a politically dominant class and secure their interests vital It has been elucidated that the state in its modern form takes different forms, at different historical moments, and acts in the most adequate way to meet the accumulation and reproduction needs of capital. We discussed the general aspects of the structural capital crisis in which the state's performance, despite the fact that neoliberalism rejects its presence in the economy, is increasingly necessary. It sought to understand the relevance of the public fund in the scenario of structural crisis, while resources administered by the State, coming from the working class, and which are passed on to financial capital. It was emphasized that the transfer of wealth, allocated in the public fund, to capital rebates in the implementation of the budget of social policies that make up Social Security, aggravates the scenario of social inequalities and removes social rights won. It has been demonstrated that the State legitimizes mechanisms of appropriation of the public fund for the payment of public debt, which has become an important instrument to guarantee profitability for the capital in crisis. It outlined the essential elements of state intervention from the "primitive accumulation of capital" to the current context of capital structural crisis to demonstrate that the state essence of the state has not changed, and thus the public fund is the instrument used by the State in this historical context of structural crisis to fulfill its social function of safeguarding capitalist interests and maintaining the social structural that antagonizes capital and labor.
