Resumo: | The present work aims to analyze the conditions and importance of offering education to adolescents and young people in compliance with socio-educational measures, attributed to pedagogical issues and teaching modalities, considering the legal and social aspects to guarantee the fundamental human right to education. , as determined by the Brazilian Federal Constitution. Presenting proposals for discussions on the subject, contextualizing norms that guide the guarantee of rights and the conditions of education offers through a socio-educational structure that includes the possibilities of the right to education. To this end, the methodological paths in the development of the work have the nature applied as a qualitative investigation approach and as technical procedures, document research. The discussions are based on authors who deal with and analyze this theme, such as: Pereira (1992), Tavares (2001), Freire (2004), Costa (2006), among others. Understanding the mechanisms and responsibilities that allow the realization of the right to education in the construction of human development and supply and access, contributes to problematizing the formative permanence in socioeducational contexts. Thus, the recognition of the contradictions and challenges of this problem raises reflections on legal aspects in directing the educational inclusion of the group in question. |

Apresentando propostas de discussões acerca da temática, contextualizando normas que norteiam a garantia dos direitos e as condições das ofertas da educação através de uma estrutura socioeducativa que inclua as possibilidades do direito à educação. Para tanto, os caminhos metodológicos no desenvolvimento do trabalho têm a natureza aplicada como abordagem de investigação qualitativa e como procedimentos técnicos a pesquisa documental. As discussões estão alicerçadas em autoras/es que tratam e analisam essa temática, como: Pereira (1992), Tavares (2001), Freire (2004), Costa (2006), entre outros. Compreender os mecanismos e responsabilidades que permitem concretização do direito à educação na construção do desenvolvimento humano e oferta e o acesso, contribui para problematizar a permanência formativa nos contextos de socioeducação.
