A RESPONSABILIDADE DA PESSOA HUMANA PELA PRESERVAÇÃO AMBIENTAL E MELHORIA DA VIDA: REFLEXÕES CONSTITUCIONAIS

Resumo: The human development has brought serious problems to nature. For a long time man sought thisdevelopment exclusively concerned with private issues, to improve only its own satisfaction and welfare.The search for a better quality of life by exploiting the environmental resources thoughtlessly results in agreat removal of resources from the planet, causing an environmental imbalance that can affect beyond thefuture generations quality of life, but the very existence of the human species on Earth. The knowledge ofthese factors brings out the need for a change in human awareness on the paths taken to achieve the desiredevolution. In the way humanity has been acting the future becomes uncertain as it depends on the resourcesthey are using in an unsustainable way. The Article 225 of the Federal Constitution constitutionalizes aright-duty to preserve the natural resources. Its third article states the creation of a solidary society as oneof the BrazilianRepublic goals. This study aims to examine these constitutional norms against the path takenby man towards development. Changes in consciousness and in human actions are what can be the startingpoint for a transformation of environmental reality. The chosen method is deductive and the researchtechnique is bibliographic.

Por muito tempo, o homembuscou esse desenvolvimento exclusivamente preocupado com questões particulares, para a melhoria esatisfação unicamente de seu bem estar. A busca por uma melhor qualidade de vida, utilizando-se derecursos ambientais disponíveis de maneira impensada, faz com que o homem retire do planeta muitosrecursos, causando um desequilíbrio ambiental que pode afetar além da qualidade de vida das futurasgerações, a própria existência da espécie humana na Terra. O conhecimento destes fatores traz a tona umanecessidade de mudança de conscientização humana a respeito dos caminhos percorridos para atingir aevolução desejada. Da maneira como a humanidade tem agido o futuro torna-se incerto, já que depende dosrecursos dos quais está utilizando de maneira insustentável. O artigo 225 da Constituição Federalconstitucionaliza um direito-dever de preservação dos recursos naturais. Seu artigo 3o estabelece como umdos objetivos da República brasileira a instituição de uma sociedade solidária. O estudo visa analisar estesdispositivos constitucionais frente ao caminho percorrido pelo homem em direção a seu desenvolvimento.Mudanças de consciência e ações humanas é que podem ser o ponto inicial para uma transformação darealidade ambiental. O método utilizado para tanto é o dedutivo e a técnica de pesquisa é bibliográfica.
