Compulsory hospitalizations and restriction of freedom of people who use drugs

Resumo: This article analyzes the justifications of the Judiciary in its determinations for the compulsory hospitalization of people who use drugs, problematizing the judicialization of health, the restriction of freedom and abstinence present in judicial decisions, which express characteristics of the penal-punitive State. Documentary research involving processes of the Secretary of Health of the State of Espírito Santo forwarded by the Judiciary, with measures that impute “treatment” to drug users in a detention institution. The main results indicated that in all 54 processes biomedical thinking was present, 39 justifications manifested legal-punitive thinking; and, only 03 justifications presented the perspective of human rights. It is noticed that judicialization, based on compulsory hospitalization measures, can contribute to the process of exclusion and violation of fundamental guarantees; leading to an increase in drug use, which must be faced with public policies that rebuild social rights.

Consiste em pesquisa documental envolvendo processos da Secretaria de Saúde do Estado do Espírito Santo encaminhados pelo judiciário, com medidas que imputam “tratamento” aos usuários de drogas em instituição de internação. Os principais resultados indicaram que em todos os 54 processos estavam presentes o pensamento biomédico, 39 justificativas manifestavam o pensamento jurídico-punitivo; e, apenas três justificativas apresentavam a perspectiva de direitos humanos.
