A genealogy of contemporary liberalism: a foucaultian criticism of german ordoliberalism

Resumo: Based on the investigations of Michel Foucault on the liberal tradition, developed particularly in the course taught at the Collège de France, titled "Birth of biopolitics", we aim to explain the criticism engaged in one of the headquarters of contemporary liberalism, namely the German ordoliberalism. With this goal, we pursue to give emphasis to the argumentative strategy of the School of Freiburg which culminates in what the French theorist called "state-phobia". We also discuss about the neoliberal model promoted by the connection between the market economy, competitive practice and "social policy". Then we show that the ordoliberalism sought to erect a Vitalpolitik articulated with a new conception of homo oeconomicus: the "company man". In achieving this aim, the law is the support of the game proposed by the competitive economics of the market. Finally, we emphasize the existence of biopolitical elements in the neoliberal model of the School of Freiburg.

Finally, we emphasize the existence of biopolitical elements in the neoliberal model of the School of Freiburg. Teniendo como base las investigaciones de Michel Foucault sobre la tradición liberal, desarrolladas, principalmente, en el curso "Nacimiento de la biopolítica" impartido en el Collège de France, procuramos explicitar la crítica emprendida hacia una de las matrices del liberalismo contemporáneo, a saber: el ordoliberalismo alemán. Con este objetivo, buscamos poner en relieve, primeramente, la estrategia argumentativa de la Escuela de Friburgo, que culmina en lo que el teórico francés denomina "fobia del Estado". Discutimos también la convergencia promovida por el modelo neoliberal entre la economía de mercado, ejercicio de la competitividad y "política social". A seguir, mostramos que, vinculado a esa lógica, el ordoliberalismo procuró erigir una Vitalpolitik articulada en una nueva concepción del homo oeconomicus: el "hombre-empresa". En la consecución de ese intento, el ordenamiento jurídico aparece como soporte en el juego propuesto por la economía de la competencia de mercado. Finalmente, enfatizamosla existencia de elementos biopolíticos en el modelo neoliberal de la Escuela de Friburgo.  Tendo por base as investigações de Michel Foucault sobre a tradição liberal, desenvolvidas sobretudo no curso ministrado no Collège de France, intitulado “Nascimento da biopolítica”, procuramos explicitar a crítica empreendida a uma das matrizes do liberalismo contemporâneo, a saber, o ordoliberalismo alemão. Com este objetivo buscamos pôr em relevo, primeiramente, a estratégia argumentativa da Escola de Friburgo que culmina no que o teórico francês denomina como “fobia do Estado”. Discutimos também a junção promovida pelo modelo neoliberal entre economia de mercado, prática concorrencial e “política social”. Em seguida, mostramos que, vinculado a essa lógica, o ordoliberalismo procurou erigir uma Vitalpolitik articulada a uma nova concepção de homo oeconomicus: o “homem-empresa”. Na consecução desse intento, o ordenamento jurídico aparece como suporte no jogo proposto pela economia concorrencial de mercado.
