Resumo: The refuge condition has become more than just a punctual political fact our modernity. The figure of the refugee, in its multiple versions, carries within it the stigma of being recognized as human, but denying citizenship. The refugee condition, which never ceases to grow throughout the world, unveils the boundaries of the nation state and its institutions unable to recognize the real equality of rights for all human beings. Giorgio Agamben´s works offers a philosophical conceptual tool for critically thinking about the refugee´s condition and the boundaries of the nation state. The new walls that are continually being built around the world reflect the political inability of the nation state to respond to the new political challenges of a nomadic humanity. The refugee operates in the present as a kind of vanguard of the people, urging us to think the categories for a new policy that does not exclude through the split of human life.

A figura do refugiado, em suas múltiplas versões, carrega em si o estigma de ser reconhecido como humano, porém negando-lhe a cidadania. A condição do refugiado, que não cessa de crescer ao longo do mundo, desvela os limites do Estado-nação e suas instituições incapazes de reconhecer a igualdade real de direitos a todos os seres humanos. A obra de Giorgio Agamben oferece um instrumental conceitual para pensarmos criticamente a condição do refugiado e os limites do Estado-nação. Os novos muros que não cessam de construir-se por todo mundo, são reflexo da incapacidade jurídico política do Estado-nação para responder aos novos desafios políticos de uma humanidade nômade.
