Personal files and patrimony: the Declaration of Public and Social Interest as an instrument of patrimonialization of archives

Resumo: The Declaration of Public and Social Interest, provided for by Law No. 8,159 of January 8, 1991, and regulated by Decree No. 4,073 of January 3, 2002, and Decree No. 10,148 of December 2, 2019, stands out as an important instrument of preservation of personal archives in Brazil. Notwithstanding the relevance of the device in the Brazilian context, its application raises conceptual and practical issues related to the preservation of archival patrimony. From the analysis of the bibliography and legislation, as well as the opinions issued by the Technical Evaluation Commission of the National Council of Archives, the criteria that presided over the evaluation of the public and social interest of personal archives, carried out between 2004 and 2016. From the results obtained, it appears that, in addition to the difficulties arising from the relationship between the archival, bibliographic and museological collections expressed in the opinions, the evaluations are still based on a concept of "national value" that orbits around great characters and general themes.

A pesar de la relevancia de la Ley en el contexto brasileño, su aplicación suscita interrogantes conceptuales y prácticas relativas a la preservación del patrimonio archivístico. A partir del análisis bibliográfico y de la legislación, así como de los dictámenes emitidos por la Comisión de Evaluación Técnica del Consejo Nacional de Archivos, se analizan los criterios que orientaron la evaluación del interés público y social de los archivos personales realizada entre los años 2004 y 2016. A partir de los resultados obtenidos, se constata que, además de las dificultades provenientes de la relación entre los acervos archivísticos, bibliográficos y museológicos, expresas en los dictámenes, las evaluaciones se fundamentan en una concepción de “valor nacional” que orbita en torno a los grandes personajes y temas generales.A Declaração de Interesse Público e Social, prevista pela Lei nº 8.159 de 8 janeiro de 1991 e regulamentada pelos Decretos nº 4.073 de 3 de janeiro de 2002 e Decreto nº 10.148 de 2 de dezembro de 2019, destaca-se como um importante instrumento de preservação dos arquivos pessoais no Brasil. Não obstante a relevância do dispositivo no contexto brasileiro, sua aplicação suscita questões conceituais e práticas relativas à preservação do patrimônio arquivístico. A partir da análise da bibliografia e da legislação, bem como dos pareceres emitidos pela Comissão Técnica de Avaliação do Conselho Nacional de Arquivos, são analisados os critérios que presidiram a avaliação do interesse público e social dos arquivos pessoais, realizada entre os anos de 2004 a 2016.
