Resumo: The text approaches the debate about the power decision specific characteristics and the judge decision legitimacy politics from twoparadigmatic understandings of the judicial decision on the Plato and Aristotle classic thought. On the confrontation between the factors judge, Politics, Law accomplishment and law limits are presented the judicial activity first divergences as elements of Law identification between the legality paradox and the decision making as positive activity.
