Resumo: In the permanent work of adapting norms to social realities, judges, based on interpretation of laws and the need to fill their gaps, sometimes accomplish jurisprudential creation of right. The air carrier’s civil responsibility for people, luggage and cargo is recent and typical of this creation of right, and overcomes gaps within the rules established by the Brazilian Aeronautic Code and by the Warsaw Convention.
