The construction of juridical-scientific knowledge for a free, fair and solidary society: analysis of awarded theses, in Law, in the light of the CAPES' concept of impact

Resumo: This article analyzes the contribution of researchers in Law to the construction of a free, fair and supportive society, supported by legal-scientific research, in addition to legal-instrumental research that characterizes the role of the operator of Law. Given this, the question is: to what extent is the researcher's work in Law able to contribute to the construction of a free, fair and solidary society, based on the production of legal research with an impact in the 21st century? To answer this question, the concept of impact and relevance of postgraduate research products, according to CAPES; and the summary of the works that received the CAPES thesis award, in Law, between 2018 and 2021 is analyzed. It is a bibliographical and documentary research, qualitative, with a hypothetical-deductive method. In the end, it is concluded that the Law researcher can contribute to the construction of a free, fair and solidary society by carrying out legal-scientific research, based on an epistemologist profile, and not a Law historian, which favors the impact of Graduate Studies in Law products and enables, through the ethics of understanding, the approximation of normative reality with the underlying empirical context to be considered.

Diante disso, questiona-se: em que medida a atuação do pesquisador em Direito é capaz de contribuir para a construção de uma sociedade livre, justa e solidária, a partir da produção de pesquisa jurídica de impacto no século XXI? Para responder a essa pergunta, aborda-se o conceito de impacto e relevância dos produtos de pesquisa de uma Pós-Graduação, segundo a CAPES; e analisa-se o resumo dos trabalhos que receberam o prêmio CAPES de tese, em Direito, entre 2018 e 2021. Trata-se de pesquisa bibliográfica e documental, qualitativa, com método hipotético-dedutivo.
