Populism and Constitutionalism in Argentina: considerations from Conceptual Legal History

Resumo: This study attempts to explore the conceptual relationship between populism and popular sovereignty within the legal discourse of constitutionalism in contemporary Argentina. To this end, the methodology chosen was based on conceptual history -Begriffsgeschichte-, which allows decomposing the "common senses" of the constitutional discourse through a double operation. The first is semasiology, which implies a study of the emergence of the word "populism" and its conceptual function as an indicator and factor of a political context which defined the preconceptions of Argentine jurists from the 1950s onwards. This approach derives in the study of onomasiology, which observes the way in which such voice was inserted in a tension between two "constitutional traditions". One liberal -1870-1930-, hostile to popular sovereignty, understanding it as tyranny of the majorities; and the other based on an unlimited popular constituent coming from the Schmittian reading of Sieyès, which culminated with the sanction of the National Constitution of 1949 during the first Peronism. The historical-conceptual key allows us to explain the use of "populism" at the level of juridical discourse, as a form of rehabilitation of the classical liberal tradition that counterposes the Constitution to the excess of a popular constituent conceived as potentially dangerous.

A esos fines la metodología elegida proviene de la historia conceptual —Begriffsgeschichte—, la cual permite descomponer los “sentidos comunes” del discurso constitucional mediante una doble operación. La primera es la semasiología, que implica un estudio acerca del surgimiento de la palabra “populismo” y su función conceptual como indicador y factor de un contexto político que definió los preconceptos de los juristas argentinos a partir de la década de 1950. Esa aproximación deriva en el estudio de la onomasiología, que observa el modo en que dicha voz se insertó en una tensión entre dos “tradiciones constitucionales”. Una liberal —1870-1930—, refractaria a la soberanía popular, entendiéndola como tiranía de las mayorías; y, otra basada en un constituyente popular ilimitado procedente de la lectura schmittiana de Sieyès, que culmina con la sanción de la Constitución Nacional de 1949 durante el primer peronismo. La clave histórico-conceptual permite explicar el uso de “populismo” al nivel de los discursos jurídicos, como una forma de rehabilitación de la tradición liberal clásica que contrapone Constitución al exceso de un constituyente popular concebido como aventurado.Este estudo busca expor a relação conceitual do populismo com a soberania popular dentro do discurso jurídico do constitucionalismo na Argentina contemporânea. Para tanto, a metodologia escolhida parte da história conceitual —Begriffsgeschichte—, que permite romper o “senso comum” do discurso constitucional por meio de uma dupla operação. A primeira é a semasiologia, que envolve um estudo sobre o surgimento da palavra "populismo" e sua função conceitual como indicador e fator de um contexto político que definiu os preconceitos dos juristas argentinos da década de 1950. No estudo da onomasiologia, que observa a forma como essa voz se inseria numa tensão entre duas "tradições constitucionais". Um liberal —1870-1930—, refratário à soberania popular, entendendo-a como tirania da maioria; e outra baseada em um constituinte popular ilimitado a partir da leitura schmittiana de Sieyès, que culmina com a sanção da Constituição Nacional de 1949 durante o primeiro peronismo.
