Resumo: This article analyzes the expansion of the juspolitical function carried by Prosecutors under the theoretical framework of Ingeborg Maus. It uses hypothetical-deductive  reasoning, drawing on data from primary and secondary nature, concluding that, to avoid arbitrariness restrictions of popular sovereignty,  it is indispensable that the Prosecution Service adopts a new institutional design, enhancing its performance by focusing on the efficient exercise of the role of superego of society.
