Resumo: | Law is inserted in the world of life. It is therefore inextricably linked to social, cultural, economic and political contingencies. Law is a dynamic science, which implies considering that new issues may become object of its interest or old issues may require current and committed reflections.One of the most recurrent issues in western philosophy of law and legal theory has been the understanding of the judge’s role and the limits of his activities. The judge has already been viewed as a mere law enforcer, a neutral figure, radically impartial, whose role was restricted to pronouncing the truth ontological-substantially provided in the law (viewed as an authoritative text). The legislative branch was in charge of making laws and the judicial branch was in charge of enforcing such laws – an ascetical division among government agencies, functions and authorities was conceived, grounded in the classical understanding of the principle of separation of powers. Creativity was restricted to the scope of the legislative function exclusively performed by the legislative branch in contrast to the enforceability of jurisdiction. Nevertheless, is there a radical way to separate creation of law from “law enforcement”? We claim there is not, that the court activity is unmistakably creative, and the obligation to (re) think the judicial function and the role of judge is due to Courts, law professionals and legal scholars, especially in times of judges playing the leading role. |

Está, pois, umbilicalmente ligado às contingências sociais, culturais, econômicas e políticas. O Direito é uma ciência dinâmica, o que implica considerar que novas questões podem vir a ser objeto de interesse do Direito ou que velhas questões podem demandar atuais e comprometidas reflexões. Uma das questões mais recorrentes no âmbito da Filosofia do Direito e Teoria do Direito ocidentais tem sido a compreensão do papel do juiz e os limites da atividade que desempenha. O juiz já foi perspectivado como um mero aplicador de leis, uma figura neutra, radicalmente imparcial, cujo papel se restringia a pronunciar a verdade substancial-ontologicamente encerrada na lei (perspectivada como um texto de autoridade). Ao Poder Legislativo cabia a criação das leis e ao Poder Judiciário a aplicação destas mesmas leis - concebia-se uma divisão asséptica entre órgãos, funções e poderes estatais, ancorada na compreensão clássica do princípio da separação dos poderes. A criatividade se restringia ao âmbito da função legiferante exercida exclusivamente pelo Poder Legislativo em contraposição à natureza executória da jurisdição[1]. Não obstante, há como separar radicalmente criação de “aplicação” do direito? Sustentaremos que não, que a atividade jurisdicional é iniludivelmente criativa, cabendo aos Tribunais, aos operadores do direito e aos juristas a obrigação de (re)pensar a função jurisdicional e o papel do juiz, especialmente em tempos de protagonismo judicial.[1] “As leis, por conseguinte, em sentido material seriam atos veiculadores de normas gerais, abstratas e inovadoras da ordem jurídica, ao passo que as decisões judiciais seriam meros atos de aplicação da ordem jurídica”.
