Este estudo é de fundamental importância, uma vez que, os alimentos compensatórios representam, um novo instituto jurídico ainda não positivado no direito brasileiro, cuja ideia ultrapassa uma indenização/compensação do cônjuge credor pela perda do padrão de vida experimentado no matrimônio e pelo desiquilíbrio econômico gerado no divórcio ou dissolução de união estável, considerando a ausência de bens comuns. Um dos objetivos deste estudo também foi a análise da confusão jurisprudencial acerca do tema, atentando-se à distinção de alimentos compensatórios patrimoniais e humanitários, bem como as diferentes naturezas do instituto. A pesquisa concluiu que a jurisprudência atual gera confusão entre os conceitos de alimentos compensatórios, afetando diretamente a vida dos cônjuges envolvidos. Apesar disso, uma parte da jurisprudência consegue examinar detalhadamente os pedidos de alimentos, baseando-se nos critérios discutidos e levantados e na análise subjetiva da limitação da responsabilidade que permeia o cônjuge alimentante.The present monographic work aims to analyze, from a jurisprudential and doctrinal perspective, the different versions and natures of compensatory alimony, as well as to identify the boundaries of the responsible spouse's liability regarding compensatory alimony. This study holds paramount importance as compensatory alimony represents a new legal institution not yet codified in Brazilian law, surpassing the idea of compensating the receiving spouse for the loss of the standard of living experienced during marriage and for the economic imbalance resulting from divorce or dissolution of a stable union, especially when there are no common assets. One of the objectives of this study was also to analyze the jurisprudential confusion surrounding the topic, focusing on the distinction between patrimonial and humanitarian compensatory alimony, as well as the different natures of this legal institution. The research concludes that current jurisprudence creates confusion regarding the concepts of compensatory alimony, directly impacting the lives of the involved spouses.
