Diante disso, em se tratando do Direito Sucessório, tornou-se comum o cenário em que o falecido deixa bens digitais, sem a realização de testamento e, dessa maneira, surgem dúvidas acerca de sua destinação. A legislação, por sua vez, não consegue acompanhar a transformação imposta pela internet, surgindo lacunas tanto na lei quanto na interpretação jurisprudencial acerca da transmissibilidade dos bens digitais após a morte, havendo ou não valoração econômica. O presente Trabalho de Conclusão de Curso objetiva, portanto, investigar a questão da referida transmissibilidade, tanto nas hipóteses em que há apreciação econômica do bem, quantos nas em que não há. Para tanto, cuidou-se de trazer os principais traços do Direito Sucessório, com o destaque para o instituto da herança. Posteriormente, realizou-se uma abordagem acerca do surgimento da internet e seus impactos sociais, resultando em transformações no mundo jurídico, devendo este se adaptar aos novos cenários, em especial no que tange à transmissão de bens digitais. Embora haja uma tentativa de se legislar sobre o assunto, fato é que diversos limites devem ser observados antes da realização da transmissão, nos casos em que se tratam de bens sem valoração econômica ou mistos, vez que aqueles que possuem valor monetário podem ser, tranquilamente, transmitidos. Os direitos da personalidade continuam após o falecimento, e isso impede, por si só, a transmissão de diversos bens. Todas essas questões foram abordadas no presente trabalho. Por meio da utilização do método hipotético-dedutivo, através de pesquisa bibliográfica e documental, concluiu-se que a melhor solução é, em um primeiro momento, a produção legislativa, a fim de estabelecer as diretrizes do tema, como o que poderá ou não ser transmitido. Assim, será dada maior segurança à redação de testamento, no qual constarão as vontades do falecido e, em sua falta, deverá ser avaliado conforme o caso concreto, sempre com a observação dos direcionamentos legislativos e a questão dos direitos da personalidade do falecido.Through the advent and the rapid advance of the internet and the virtual media, large social impacts were acknowledged, with notable consequences on the legal universe. In face of that, regarding Succession Law, the situation in which the deceased leaves digital assets without making a will has become common, thus raising doubts concerning the assets’ destination. The law, in turn, cannot keep up with the transformation led by the internet, allowing the emergence of gaps, both in the law and in the jurisprudential interpretation, about the transferability of digital assets with or without economic valuation after death. Therefore, the present undergraduate thesis’ objective is to investigate the issue of the referred transferability, on both scenarios: the one in which there is economic appreciation of the asset, and the one in which there is not. For that matter, the main features of Succession Law were accurately brought to light, with the emphasis on the institute of heritage. After that, an approach regarding the outcome of the internet and its social impacts was made, which has been transforming the legal world. This legal world has to be adapted to the new situations, specially concerning the transferability of digital assets. Though there is the attempt to legislate about this subject, the fact is that several limits have to be taken into consideration before the act of transferability, mostly in cases regarding assets without economic valuation or when the assets are mixed, given the fact that the ones which have monetary value can be easily transferred. On the other hand, the personality rights continue after death, making it impossible to transfer various assets. All of those issues will be approached on the present paper by means of using hypothetical-deductive method, and bibliographic and documentary research; it is concluded that the best solution, after having a legislation, is to write a will, in which the deceased’s wills appears.
