Tal procedimento tem sido realizado desde a década de 1980, sendo inicialmente exclusivo a animais de menor porte e passando a ser utilizado em mamíferos de maior porte com interesse comercial associado. Nesse mesmo período, a teoria dos direitos dos animais, com sua inclinação abolicionista, igualmente passou a ganhar força, buscando proteger a vida, a liberdade e a integridade física dos animais não humanos. No Brasil, as atividades e projetos que envolvem animais geneticamente modificados devem obedecer à Lei da Biossegurança, a qual, por sua vez, não veda a manipulação genética de animais. Ademais, a regulamentação de biossegurança determina que compete à Comissão Técnica Nacional de Biossegurança estabelecer o Código de Ética de Manipulações Genéticas, o qual não foi criado até o momento. Nesse contexto, a proteção dos animais frente à crueldade e maus-tratos encontra-se fundamentada no artigo 225, § 1º, inciso VII, e no artigo 32 da Lei de Crimes Ambientais. Recentemente foram liberados mosquitos Aedes aegypti transgênicos no estado da Bahia, e embora não existam certezas científicas sobre as consequências que tal ato possa causar ao meio ambiente, bem como saúde humana e animal, pouca discussão acadêmica foi levantada a respeito do assunto. Por conseguinte, frente à crescente relevância e atualidade da temática, o presente trabalho objetiva realizar uma análise ético-jurídica da transgenia animal, contemplando reflexões éticas realizadas sob as vertentes sensiocêntrica, abolicionista e biocêntrica, bem como as implicações jurídicas da transgenia animal. Para atingir tal objetivo utilizar-se-á os métodos de abordagem dedutivo e indutivo, o método de procedimento monográfico e as técnicas de pesquisa bibligráfica e documental.It is current the genetic modification of animals in order to originate benefits to humans. This procedure has been performed since the 80s, starting exclusively on smaller animals and, gradually, on larger mammals with associated commercial interests. In the same period, the Animal´s Rights Theory, with its abolitionist approach, also began to gain strength, seeking to protect the life, liberty and physical integrity of nonhuman animals. In Brazil, activities and projects involving genetically modified animals must obey the Law of Biosecurity, which, in turn, does not forbid the genetic manipulation of animals. Moreover, biosafety regulation states that the Commission National Biosafety Technical must establish the Code of Ethics of Genetic Manipulations, which has not been created yet. In this context, the protection of animals against the cruelty and ill-treatment is based on Article 225, first paragraph, subsection VII and Article 32 of the Environmental Crimes Law. Recently, transgenic Aegypti aedes mosquitoes have been released in the state of Bahia and although there were no scientific certainty about the consequences that such act could cause to the environment and human and animal health, little academic discussion was raised about the subject. Therefore, faced with this theme´s growing importance and topicality, the present work aims to achieve an ethical and legal analysis of animal transgenesis, contemplating ethical reflections carried out under the sencioncentric, abolitionist and biocentric strands, as well as the legal implications of animal transgenesis.
