Com o objetivo de aprofundar essa investigação, foi proposta a análise da legislação que prevê o instituto brasileiro, bem como a forma como os poderes se estruturam e se interrelacionam, podendo influenciar, de certa forma, na aplicação do mecanismo de destituição do cargo do Chefe do Executivo. Por meio do método dedutivo, partindo de teorias inerentes à discussão, concluiu-se que o impeachment, nos moldes executados no Brasil, pode apresentar aproximações ao recall, vez que, apesar de formalmente possuir caráter político e jurídico, há situações em que apenas é evidenciada sua natureza política - o que decorre das fragilidades verificadas na legislação que regulamenta o instituto e das questões inerentes ao multipartidarismo.Within the reality of the Brazilian coalitional presidentialism, the impeachment raises questions regarding its nature, since similarities to the political recall mechanism can be verified. To address this issue, it was proposed an analysis of the legislation that institutes the Brazilian impeachment mechanism as well as the way the branches of government are structured and interact with each other, which may, somehow, influence in how the instruments of destitution of the head of the executive are applied.
