TOGETHER AND EQUAL? OF THE NECESSARY FOUNDAMENTATION OF THE RIGHT TO EQUALITY BEYOND THE CASE BROWN V. BOARD OF EDUCATION

Resumo: This paper purpose examines the evolution of the jurisprudence of the Supreme Court of the United States regarding the guarantee of the right to equality and non-discrimination. It is questioned whether if the doctrine of equal protection inaugurated in the Board of Education of Topeka case is enough to ensure equality for the African-American population due to the recent history of racial segregation in that country. In other words, it seeks to examine to what extent equal protection doctrine is an effective response to the separate but equal segregation policy ratified by the Supreme Court. It is evaluated, with the application of the inductive method, and according the concepts of direct discrimination, indirect discrimination, equal protection, disparate impact, separate but equal, as well as the positive obligations resulting from the duty of non-discrimination, and, still, in the process of American slavery, that the decision of the Board of Education case is not enough to guarantee material equality. In this sense, is sustained the application of affirmative measures for the effectiveness of equality in relation to historically marginalized groups.

Se pregunta si la doctrina de la equal protection, inaugurada en el caso Board of Education of Topeka, es suficiente para asegurar la igualdad a la populación afroamericana debido al histórico reciente de segregación racial en dicho país. Es decir, se intenta examinar si la equal protection es una respuesta eficaz a lo separate but equal, política de segregación ratificada por la Suprema Corte. Se evalúa, con la aplicación del método inductivo, y bajo los conceptos de discriminación directa, discriminación indirecta, equal protection, diparate impact, separate but equal, así como las obligaciones positivas decurrentes del deber de no discriminación, y, aún, en el proceso de esclavitud estadunidense, que la decisión afincada en el caso Board of Education no es suficiente para garantizar la igualdad material. De ese modo, se sostiene la aplicación de medida afirmativas para la eficacia de la igualdad em relación a grupos históricamente marginalizados.Este artigo objetiva avaliar a evolução da jurisprudência da Suprema Corte dos Estados Unidos no que se refere à garantia do direito à igualdade e a não discriminação. Questiona-se se a doutrina da equal protection, inaugurada no caso Board of Education of Topeka, é suficiente para assegurar a igualdade à população afro-americana em vista do histórico recente de segregação racial naquele país. Isto é, procura-se examinar em que sentido a equal protection é uma resposta eficaz ao separete but equal, política segregatória ratificada pela própria Suprema Corte. Avalia-se, pela aplicação do método indutivo, com base nos conceitos de discriminação direta, discriminação indireta, equal protection, diparate impact, separate but equal, bem como as obrigações positivas decorrentes do dever de não discriminação, e, ainda, no processo de escravidão estadunidense, que a posição sedimentada no caso Board of Education não é suficiente para a garantia da igualdade material.
