NUCLEAR ENERGY AND ENVIRONMENTAL AWARENESS: FOR A REGULATORY GLOBAL GOVERNANCE CONCERTED

Resumo: This article analyze the nuances around the problem and the participatory/deliberative and regulatory global governance about the safe and definitive disposal of tailings generated by the energetic nuclear industry, witch, in the current conjuncture of scientific and technological development, has two main possibilities of final destination, namely, in the environment directly and the definitive containment of the tailings in the repositories, that may require storage time of hundreds of thousands of years. In this context, the biggest problem lies in everything that a repository of this magnitude demands in terms of preserving public health and environmental balance. The results of the research show that disposing of highly radioactive nuclear waste directly in the environment is not viable due to the environmental degradation and risks to human health caused. This leads to the conclusion that, in order to preserve public health and environmental balance, it is necessary to dispose of it in repositories, whose long-term management is only guaranteed through the use of global regulatory governance that is supposed to be concerted and thus capable of allowing not only participation, but also deliberation in the debates and control by all those interested and involved in the process. In this way, the article explore, through historical and deductive methods, the stages of development of the global environmental awareness and the nuclear technology, pointing out the relevance and dangers of its use and the need for its global participatory and regulatory governance.

In this way, the article explore, through historical and deductive methods, the stages of development of the global environmental awareness and the nuclear technology, pointing out the relevance and dangers of its use and the need for its global participatory and regulatory governance.Este artículo analiza los matices de la problemática y de la gobernanza global regulatoria participativa/deliberativa con respecto a la disposición segura y definitiva de los residuos generados por la industria de la energía nuclear, por cuanto, en la coyuntura actual de desarrollo científico y tecnológico, lleva dos posibilidades principales de disposición final, a saber, en el medio ambiente, directamente, y la contención definitiva de los residuos en repositorios, a veces durante cientos de miles de años. En este contexto, el mayor problema radica en todo lo que un repositorio de esta magnitud exige en términos de preservar la salud pública y el equilibrio ambiental. Los resultados de la investigación muestran que la eliminación de los residuos nucleares de alta actividad directamente en el medio ambiente no es viable debido a la degradación ambiental y a los riesgos para la salud humana que provoca, lo que lleva a la conclusión de que, para preservar la salud pública y el equilibrio ambiental, es necesario eliminarlos en depósitos, cuya gestión a largo plazo sólo se garantiza mediante el uso de una gobernanza reguladora global que se supone concertada y, por tanto, capaz de permitir no sólo la participación, sino también la deliberación en los debates y el control por parte de todos los interesados e implicados en el proceso. Por lo tanto, el artículo discute, a través de métodos históricos y deductivos, las etapas de desarrollo de la conciencia ambiental global y la tecnología nuclear, señalando la relevancia, los peligros de su uso y la necesidad de una gobernanza reguladora global participativa/deliberativa. O presente estudo analisa as nuances da problemática e da governança global regulatória participativa/deliberativa sobre a disposição segura e definitiva de rejeitos gerados pela indústria nuclear energética, vez que, na atual conjuntura do desenvolvimento científico e tecnológico, comporta duas possibilidades principais de destinação final, quais sejam, no meio ambiente, de forma direta, e o confinamento definitivo dos rejeitos nos repositórios, às vezes, por centenas de milhares de anos. Nesse contexto, o maior problema encontra-se em tudo que um repositório desta magnitude demanda em termos de preservação da saúde pública e do equilíbrio meio ambiental. Como resultados decorrentes da pesquisa, verifica-se que a disposição dos rejeitos nucleares de alto nível de atividade diretamente no meio ambiente não é viável em razão da degradação ambiental e dos riscos à saúde humana causados, o que permite se concluir que, para a preservação da saúde pública e do equilíbrio meio ambiental, torna-se necessário sua disposição em repositórios, cuja segurança de sua gestão a longo prazo somente se tem garantida mediante o emprego de uma governança global regulatória pressupostamente concertada e, assim, capaz de permitir não apenas a participação, mas a deliberação nos debates e o controle de todos os interessados e envolvidos no processo.
