REGIONAL INTEGRATION AND BORDER MANAGEMENT: : THE LEGAL IMPACTS OF FRONTEX ON THE FREE MOVEMENT OF PERSONS AND ON MIGRATION IN THE EUROPEAN UNION

Resumo: The article addresses border discipline in the context of regional integration, highlighting the legal impacts of regional border management on human mobility. Focusing on the European Union, the study focuses on integrated European border management, based on the agency FRONTEX's role, by problematizing the agency's functions as a tool to ensure the free movement of people and to strengthen the management of migration. Based on the foundations of European law, the objective is to investigate the regulation of borders in European integration, as well as to analyze the action of FRONTEX in the supranational order and its impacts on the movement of persons. To do so, it uses the deductive method and the literature review, under theoretical discussion that involves the economic theory of integration and the critical theory of securitization. It can be seen that the European experience challenges a frontier dynamic that deal with free movement internally, while externally hardens controls, which accentuates the duality of treatment between Europeans and non europeans in terms of mobility.

Con un enfoque en la Unión Europea, el énfasis está en la gestión integrada de las fronteras europeas, basada en el papel de la agencia FRONTEX, al problematizar las funciones de la agencia como una herramienta para garantizar la libre circulación de personas y la gestión de la migración. Basado en los fundamentos del derecho europeo, el objetivo es investigar la regulación de las fronteras en la integración europea, así como analizar la acción de FRONTEX en el orden supranacional y sus impactos en el movimiento de personas. Para este fin, se utilizan el método deductivo y la revisión de la literatura, bajo discusión teórica que involucra la teoría económica de la integración y la teoría crítica de la seguridad. Se puede ver que la experiencia europea desafía una dinámica de frontera que trata con la libre circulación, al tiempo que endurece los controles externos, lo que acentúa la dualidad de trato entre europeos y extranjeros en términos de movilidad.O artigo aborda o disciplinamento das fronteiras no contexto da integração regional, destacando os impactos jurídicos da gestão das fronteiras regionais para a mobilidade humana. Com foco na União Europeia, centra-se a análise na gestão europeia integrada de fronteiras, a partir da atuação da agência FRONTEX, ao problematizar as funções dessa agência como instrumento para garantir a livre circulação de pessoas e para reforçar a gestão das migrações. A partir dos fundamentos do direito europeu, objetiva-se investigar a regulamentação das fronteiras na integração europeia, bem como analisar a atuação da FRONTEX na ordem supranacional e seus impactos para a circulação de pessoas. Para tanto, utiliza-se do método dedutivo e da revisão bibliográfica, sob discussão teórica que envolve a teoria econômica da integração e a teoria crítica da securitização.
