Gestão de conflitos na administração pública: proposta de implementação de câmara de mediação na Universidade Federal do Pampa

Resumo: | Conflicts are present in people's daily lives, since they are inherent to interpersonal relationships, especially in work relationships. Therefore, the existing methods of selfcomposition, such as mediation, emerge as cooperative and dialogic means to resolve conflicts effectively and peacefully. The implementation of a mediation chamber is an example of good governance practice, fostering the Institution integrity program, an instrument of preventing ethical and conduct deviations, and has the main purpose of solving and managing existing conflicts and, thus, collaborating with the scope of public service efficiency. The general objective of this work was to analyze the conception of the servers of the Federal University of Pampa (Unipampa) on the possibility of creating a Mediation Chamber in the Institution. The first specific objective was to analyze existing studies on conflict resolutions in the area of Administration. The second specific objective sought to verify how Unipampa resolves interpersonal conflicts. The third specific objective was to identify the conception of Unipampa servers on alternative methods of conflict resolutions, as well as their opinion about the creation of an Institutional Mediation Chamber. The last had the specific objective of proposing procedures for the establishment of a Mediation Chamber for interpersonal conflicts at Unipampa. Chapter 1 presents the introduction, the problem and the research objectives, the justification, and the structure of the work; Chapter 2 presents the theoretical framework; chapter 3 shows the methodology used; Chapter 4 contains the results of data analysis and discussion; chapter 5 presents the product of this dissertation, with the presentation of an action plan for the implementation of the Institutional Mediation Chamber; in chapter 6 are the final considerations and in chapter 7 there are the bibliographic references. This research was carried out by using the explanatory sequential mixed method, which mixes quantitative and qualitative approaches, with the application of an online questionnaire to Unipampa's servers, afterwards, a virtual meeting was held to implement a focus group with six selected servers considered qualified informants of the research, due to the Covid-19 pandemic. Interlinking the results with the specific objectives, the following categories of analysis were determined: a) Employees' knowledge about the resolution of interpersonal conflicts in the Institution and b) Employees' interest in the implementation of an Institutional Mediation Chamber. Through research in the databases of the Web of Science and Spell journals, it was possible to verify that the researches on the topic of conflict resolution are recurrent in the area of Law, but with few publications in the area of Public Administration. In addition, after analyzing the results of the questionnaire and the focus group, it was noticed that academic conflicts are the most recurrent, with the opening of dialogue being the most used way by the servers and managers of the University to solve them. It was verified the knowledge of the servers by the mediation method and their interest in the establishment of the Institutional Mediation Chamber. |

Desta maneira, os métodos de autocomposição existentes, como exemplo a mediação, surgem como meios cooperativos e dialogados para resolver os conflitos de maneira eficaz e pacífica. A implementação de câmara de mediação é um exemplo de boa prática de governança, fomento ao programa de integridade da Instituição, instrumento de prevenção de desvios éticos e de conduta e tem a finalidade principal de solucionar e gerir os conflitos existentes e, assim, colaborar com o alcance da eficiência do serviço público. O objetivo geral deste trabalho foi de analisar a concepção dos servidores da Universidade Federal do Pampa (Unipampa) sobre a possibilidade de criação de uma Câmara de Mediação na Instituição. O primeiro objetivo específico foi de analisar os estudos existentes sobre resolução de conflitos na área da Administração. O segundo objetivo específico buscou verificar como a Unipampa resolve os conflitos interpessoais. O terceiro objetivo específico tratou de identificar a concepção dos servidores da Unipampa sobre os métodos alternativos de resolução de conflitos, bem como a opinião deles acerca da criação de uma Câmara de Mediação Institucional. O último tinha como objetivo específico propor procedimentos para a instauração de uma Câmara de Mediação de conflitos interpessoais na Unipampa. No capítulo 1 apresenta-se a introdução, o problema e os objetivos da pesquisa, a justificativa e a estrutura do trabalho; no capítulo 2 apresenta-se o referencial teórico; no capítulo 3 demonstra-se a metodologia utilizada; no capítulo 4 contêm os resultados das análise de dados e discussão; o capítulo 5 apresenta o produto desta dissertação, com a apresentação de um plano de ação para a implementação de Câmara de Mediação Institucional; no capítulo 6 estão as considerações finais e no capítulo 7 as referências bibliográficas. Realizou-se esta pesquisa utilizando o método misto sequencial explanatório, que mescla abordagens quantitativas e qualitativas, com a aplicação de questionário online aos servidores da Unipampa e, após, efetuou-se encontro virtual para realização de grupo focal, com seis servidores selecionados, considerados informantes qualificados da pesquisa, em virtude da pandemia do Covid-19. Interligando os resultados com os objetivos específicos, determinou-se as seguintes categorias de análises: a) Conhecimento dos servidores sobre a resolução de conflitos interpessoais na Instituição e b) Interesse dos servidores sobre a implantação de uma Câmara de Mediação Institucional. Por meio de pesquisa nas bases dos periódicos Web of Science e Spell foi possível constatar que as pesquisas no tema resolução de conflitos são recorrentes na área do Direito, mas com poucas publicações na área da Administração Pública. Ainda, após análises dos resultados do questionário e do grupo focal, percebeu-se que os conflitos acadêmicos são os mais recorrentes, sendo a abertura do diálogo a maneira mais utilizada pelos servidores e gestores da Universidade para solucioná-los.
