Resumo: | The present dissertation aims to understand the influence of the media on judicial decisions in times of network society. To make this possible, the work is divided into three main sections. It begins by investigating the relationship established between social appeal, mediatization of cases and discretionary decision-making in law, dealing with how the media appeal, fostered by popular concerns, corroborates the subjectivity-ridden judicial decision-making and the strenghtening of the paradigm of philosophy of consciousness in field of procedural jurisdiction. The second chapter verifies the importance of talking about and ontological-linguistic turn to jurisdiction contemporaneously, in the sphere of judicial decisions, dealing with the need for an invasion of language in philosophy in the process as a condition of possibility for the removal of philosophy of consciousness and its consequent subjectivity on judicial decisions. Finally, the third section studies the (im)possibility of having a procedural jurisdiction hostage to the uncontrollability of judicial decisions present in the discretion in the strong sense under the mantle of Ronald Dworkin’s theory, establishing bases with a contemporary constitutionalism, from the need to understand the judicial process constitutionally and hermeneutically. Allied to this, it verifies the thesis of the correct answer in this context, resorting to the duties of coherence and integrity to judicial answers given in the scenario of the network society and, more than that, of a hermeneutically adequate answer to the Constitution, as a fundamnetally enshrined right. Thus, the question is: how does the media, as an instrument for reproducing the social clamor, influences judicial decision-makings in times of a network society? So, what is the place occupied by the philosophy of language in this scenario? To solve the research problem raised, the phenomenological-hermeneutic approach is used, since the essay is anchored in language as a space for the happening of Being. As the basis theory, the work has the hermeneutic theory, specifically with regard to the hermeneutic critique of law, with the structural pillars fixed in the theories of hermeneutic philosophy, of Martin Heidegger, of philosophical hermeneutics, of Hans-Georg Gadamer and in the anti-relativism of Ronald Dworkin. At the end of the research, it is possible to conclude that the influence of the media on judicial decision-making in times of a network society is affirmed by the symbiotic relationship established between social appeal and media, as a powerful mechanism to pressure the Judiciary, mainly through communicational technologie. From the media appeal, the judicial process becomes spetacular and can activate subjectivities in the decision-making act, which leads to judicial decisions that are based on elements that do not legally and constitutionally serve a democratic State of law. Responses based on moral convictions, social appeals, past experiences and personal feelings can emerge from this complex phenomenon, bringing (or maintaining) to the terrain of contemporary jurisdiction the rancidity of the philosoplhy of conscience paradigm, in the form of discretionary decisions. The place occupied by the philosophy of language in this scenario, in turn, is in the very function of language, which, in procedural jurisdiction, consists of providing the demonstration that judicial responser are the result of demonstrative expositions, and not deductive reasoning. Answers must be hermeneutically constructed and, decisively, the subjectivity of judgements is no tone of the pillars of this construction. Language enables the pré-understanding and comprehension of the judge, in addition to being indispensable for the establishment of the correct relationship between subject and object. Furthermore, it is a condition of possibility for the subject to know the world and, also, for the world itself to exist. |

Para que isso seja possível, o trabalho é dividido em três seções principais. Inicia-se pela investigação da relação estabelecida entre apelo social, midiatização de casos e a tomada de decisões discricionárias em direito, tratando sobre como o apelo midiático, fomentado pelos anseios populares, corrobora para a tomada de decisões judiciais eivadas de subjetividade e para o fortalecimento do paradigma da filosofia da consciência no campo da jurisdição processual. O segundo capítulo verifica a importância de se falar em giro ontológico-linguístico à jurisdição contemporaneamente, na esfera das decisões judiciais, tratando da necessidade de uma invasão da linguagem na filosofia no processo como condição de possibilidade para o afastamento da filosofia da consciência e de sua consequente subjetividade assujeitadora nas decisões judiciais. Além disso, compreende a incompatibilidade do paradigma da consciência com o panorama atual do direito a partir de uma perspectiva filosófico-hermenêutica. Por fim, a terceira seção estuda a (im)possibilidade de haver uma jurisdição processual refém da incontrolabilidade de decisões judiciais presentes na discricionariedade no sentido forte sob o manto da teoria de Ronald Dworkin, estabelecendo bases com um constitucionalismo contemporâneo, a partir da necessidade de se compreender constitucional e hermeneuticamente o processo judicial. Aliado a isso, verifica a tese da resposta correta nesse contexto, recorrendo aos deveres de coerência e integridade às respostas judiciais proferidas no cenário da sociedade em rede e, mais que isso, de uma resposta hermeneuticamente adequada à Constituição, enquanto direito fundamentalmente consagrado. Assim, questiona-se: como a mídia, enquanto instrumento de reprodução do clamor social, influencia na tomada de decisões judiciais em tempos de sociedade em rede? Destarte, qual o local ocupado pela filosofia da linguagem nesse cenário? Para solucionar o problema de pesquisa levantado, utiliza-se a abordagem fenomenológico-hermenêutica, já que o ensaio ancora-se na liguagem como espaço de acontecimento do Ser. Como teoria de base, o trabalho tem a teoria hermenêutica, especificamente no que diz respeito à crítica hermenêutica do direito, com os pilares estruturais fixados nas teorias da filosofia hermenêutica, de Martin Heidegger, da hermenêutica filosófica, de Hans-Georg Gadamer e no anti-relativismo de Ronald Dworkin. Ao final da pesquisa, é possível concluir que a influência da mídia na tomada de decisões judiciais em tempos de sociedade em rede é afirmada pela relação simbiótica estabelecida entre apelo social e mídias, enquanto mecanismo poderoso para pressionar o Poder Judiciário, principalmente por meio das tecnologias comunicacionais. A partir do apelo midiático o processo judicial se espetaculariza e pode ativar subjetividades no ato decisório, o que desagua em decisões judiciais que se fundamentem em elementos que não que servem legal e constitucionalmente a um Estado democrático de direito. Respostas com base em convicções morais, apelos sociais, experiências passadas e sentimentos pessoais podem eclodir desse complexo fenômeno, trazendo (ou mantendo) ao terreno da jurisdição contemporânea o ranço do paradigma da filosofia da consciência, na forma de decisões discricionárias. O local ocupado pela filosofia da linguagem nesse cenário, por sua vez, está na própria função da linguagem, que, na jurisdição processual, consiste em proporcionar a demonstração de que respostas judiciais são frutos de exposições demonstrativas, e não de fundamentações dedutivas. Respostas devem ser hermeneuticamente construídas e, decisivamente, a subjetividade dos julgados não é um dos pilares dessa construção. A linguagem possibilita a pré-compreensão e compreensão do julgador, além de ser indispensável para o estabelecimento da correta relação entre sujeito e objeto. Responses based on moral convictions, social appeals, past experiences and personal feelings can emerge from this complex phenomenon, bringing (or maintaining) to the terrain of contemporary jurisdiction the rancidity of the philosoplhy of conscience paradigm, in the form of discretionary decisions. The place occupied by the philosophy of language in this scenario, in turn, is in the very function of language, which, in procedural jurisdiction, consists of providing the demonstration that judicial responser are the result of demonstrative expositions, and not deductive reasoning. Answers must be hermeneutically constructed and, decisively, the subjectivity of judgements is no tone of the pillars of this construction. Language enables the pré-understanding and comprehension of the judge, in addition to being indispensable for the establishment of the correct relationship between subject and object. Furthermore, it is a condition of possibility for the subject to know the world and, also, for the world itself to exist. |
