This research aims to investigate if Michael Walzer's Just War theory leads to the rise of the international exception due to its unilateral humanitarian interventions. The theory was used as a framework to verify if its justifiers legitimize the existence of an acceptable international exception in certain situations, since under the justification of humanitarian intervention or the " war against terror," states promote interventions that jeopardize the international order and the protection of human rights. To do so, we sought to identify the correlation and applicability of Walzer's Theory within the concept of the state of exception by reviewing the author's literature on Just War Theory, its critiques, and the collection of writings on the international exception. We conclude that Walzer's theory can lead to the international exception and threaten the protection of human rights and the international order.
