Resumo: This research aims to discuss the migration policies in Brazil aimed at ensuring the education of refugee children. Firstly, is presented the concept of refuge and a brief history of refugees in the world and concomitantly of the protective organs of this group that emerged over time. Accordingly, the nacional and international laws that apply to refugees in Brazil are discussed, and the guarantees of refugee children in the country are exposed. Finally, is analyzed the educational data in Brazil, as well as the obstacles that children, especially refugees, face in order to have access to education, and then come to a conclusion if the Brazilian state has the necessary resources and capacity to guarantee education. of all refugee children in the country.
