The present study aims to analyze the outsourcing institute, which is a form of structural organization that allows the companys the transfer of its activities and its means of production to another company. The discussion is about how this occurrence happens in Brazil, especially in the private sector, which most often is drawn with a particular lack of normative rule on the subject. it is also discussed about the latest legislative innovations promoted, which increased the possibilities of outsourcing in the country. The outsourcing as a form of precariousness and exploration of work is at the center of the debate. Therefore, in order to avoid that the outsourced measure is used only for the purpose of mitigating labor rights, it is shown at the end of the study, important mechanisms for prevention to the precariousness imposed by the unrestricted outsourcing adopted in Brazil.
