Direito editorial: a editoração pública brasileira como um microssistema jurídico

This study maps the legal micro system that involves publishing by Brazilian public institutions. Publishing activities have technical and normative peculiarities that are often not discussed by jurisprudence or by statutory law. This legal insecurity affects the intellectual production especially by Brazilian federal university presses. This work considers Publishing Law as distinct from other branches of Law, but in dialogue with Administrative and Intellectual Property Law, which includes Copyright Law. This study employs systems theory to understand the editorial legal microsystem. Data collection and analysis had basis on statutory, technical norms and document readings, supplemented by the author’s participantobservation experience working at a federal university press. It has been found that the publishing process, as well as the publishing object and the subjects by public institutions have normative ground, forming a legal microsystem, albeit with sparse norms.
