Resumo: This article will initially address the legal and doctrinal concepts, the fundamentals, the procedure and the hypothesis of incurrence of intercurrent prescription in tax enforcement, as well as its characteristics and objectives. Then, it will be discussed about the new theses signed by the Superior Court of Justice - STJ in the judgment Special Appeal nº. 1.340.553/RS, under the rite of repetitive appeals, explaining the main changes established in the recent jurisprudential understanding.
