Resumo: This paper has the general objective of understanding the performance of the Judiciary, under the prism of the phenomena of judicialization of politics and judicial activism. Through bibliographical research, as well as observing the deductive methodological criterion, it seeks to understand the protagonism of the Judiciary in the contemporary Brazilian context, which is materialized in a broader and more intense participation of the judiciary in the realization of constitutional values, with a consequent expansion of its powers to areas that are traditionally assigned to the other Powers. Finally, it will be demonstrated that the ineffectiveness of constitutional guarantees is a factor that diminishes the strength of the constitutional text, which is of paramount importance for the organization of the Brazilian Democratic State.
